民事拘传适用对象的再甄别——以《民诉法解释》第174条为靶标

【摘要】：《最高人民法院关于适用中华人民共和国民事诉讼法的解释》第174条突破了现行《民事诉讼法》的规定,任性地将民事拘传的对象适用于特定原告。这一规定体现了我国民事诉讼国家干预主义之"特色",与民事诉讼解决私权纠纷之特质相去甚远。民事拘传适用于特定原告是对当事人处分权的粗暴干预,既有违民事诉讼法和立法法的规定,亦与民事诉讼之法理相悖,在司法实践中必然缺乏操作性。就民事拘传制度的功能而言,该制度依然有其存在的必要性和合理性。问题的关键是理性甄别民事拘传的适用对象。结合民事司法实践和民事诉讼法理,民事拘传制度应当还原其限制性地适用于特定被告之规定,并将拘传扩大适用于必须到庭的证人。唯有如此,才能发挥民事拘传制度的制裁功能。
[Abstract]:Article 174 of the interpretation of the Supreme people's Court on the Application of the Civil procedure Law of the people's Republic of China has broken through the provisions of the current Civil procedure Law, Willfully apply the object of civil detention to a specific plaintiff. This provision reflects the "characteristics" of state interventionism in civil litigation in China, which is far from the nature of civil litigation in resolving private disputes. The determination of the plaintiff is a gross interference with the party's right to dispose, It is not only contrary to the provisions of the Civil procedure Law and the Legislative Law, but also contrary to the legal principles of the Civil procedure Law, which is inevitably lack of operability in the judicial practice. As far as the function of the civil detention system is concerned, This system still has its necessity and rationality. The key to the problem lies in the rational identification of the applicable object of civil detention, and the combination of civil judicial practice and civil procedural law. The civil detention system should restore its restrictive application to the specific accused, and expand the application of the detention to witnesses who must come to court. Only in this way, can the civil detention system play the role of sanction.
