论刑事司法与国家治理路径

【摘要】：刑事司法是治国理政的重器,与国家治理紧密相关。推进国家治理现代化的新时代,对刑事司法制度改革创新发展提出了新课题、新任务。刑事司法的内部性和外部性因素是相互统一的。通过刑事司法的改革创新发展来推进国家治理现代化,应当综合运用调整社会心理和刑事治理观念策略,把握转型期刑事治理的新规律、新特点,建立刑事法治与行政治理、立法规制相衔接的刑事治理机制,掌控司法供给方向,提升刑事治理品格,科学设定刑事司法制度及司法绩效评价标准,加快培育法治文化、夯实刑事治理核心基础等路径和措施,增强治理效能。
[Abstract]:Criminal justice is an important instrument for governing and managing the country, which is closely related to national governance. In the new era of promoting the modernization of national governance, a new subject has been put forward for the reform and innovation of the criminal justice system. The internal and external factors of criminal justice are mutually unified. To promote the modernization of national governance through the reform and innovation of criminal justice, we should comprehensively apply the strategies of adjusting social psychology and the concept of criminal governance. To grasp the new law and new characteristics of criminal governance in the transitional period, to establish the criminal governance mechanism of criminal rule by law and administrative governance, to control the direction of judicial supply, and to promote the character of criminal governance. Set up the criminal justice system and judicial performance evaluation standard scientifically, speed up the cultivation of the culture of rule of law, consolidate the core of criminal governance and other paths and measures, strengthen the effectiveness of governance.
