论家事案件的类型化及其程序法理

【摘要】：家庭关系的复杂性、特殊性,使得家事案件呈现出与一般民事案件不同的特性,这些特性要求将家事案件作类型化区分。尽管域外立法对家事案件的分类并不相同,但对其进行类型化区分,已形成共识。家事案件类型化有助于家事法官厘清各类家事案件之程序性质,妥为选用与家事案件类型相匹配的程序法理,如家事诉讼法理、非讼法理、交错适用法理、综合性程序法理等,进而推进家事纷争之圆满、妥当解决,实现家庭领域的司法正义。
[Abstract]:The complexity and particularity of family relations make family cases have different characteristics from general civil cases. These characteristics require that family cases be classified. Although the classification of family cases is not the same as that of extraterritorial legislation, However, there is a consensus that the classification of family cases can help the family judges to clarify the procedural nature of all kinds of family cases, and to properly select the procedural principles that match the types of family cases, such as the procedural principles of family cases. Non-litigation legal theory, staggered application of legal theory, comprehensive procedural jurisprudence, and so on, and then to promote the satisfactory family disputes, properly resolved, to achieve judicial justice in the field of family.
