辨认引发错案分析

【摘要】：刑事辨认程序的规范与否关系到是否能准确地惩罚犯罪，关系到犯罪嫌疑人、被告人的诉讼权利是否能得到有效保障，关系到司法正义是否能在个案中得以彰显。但实践中辨认出现错误也是较为普遍的，国外因此对辨认作出了相对严格的规范。尽管我国实践中辨认引发错案发生频率很高，但现行刑事诉讼却存在缺失，警、检部门的规定也较为粗疏。我国刑事辨认制度的完善，，需要纳入到刑事诉讼法的进一步修改中，首先要健全辨认活动的规则，确立办案人员与辨认主持人分离规则、辨认前的提醒规则、依次辨认等若干规则；其次要赋予辩护律师在场权，保障被辨认人的权利；最后完善辨认结论的审查运用，详细记载辨认笔录的内容及确立审查标准。
[Abstract]:Whether the criminal identification procedure is standardized or not is related to whether or not the crime can be punished accurately, whether the criminal suspects, whether the defendant's procedural rights can be effectively protected, It is related to whether judicial justice can be manifested in individual cases. However, it is common to identify errors in practice, and foreign countries have made relatively strict rules on identification. However, the current criminal proceedings are lacking, and the regulations of the police and procuratorial departments are also relatively rudimentary. The perfection of the criminal identification system in China needs to be incorporated into the further revision of the Criminal procedure Law. First of all, it is necessary to perfect the rules of identification activities. To establish the rules of separating the case handlers from the identifiers, the rules of reminding before identification, and so on; secondly, to grant defense counsel the right to be present and to protect the rights of the persons identified; finally, to perfect the examination and application of the identification conclusions. Record the contents of the identification record and establish the standard of examination.
