刑事技术侦查措施相关问题研究

【摘要】：刑事技术侦查措施已经成为世界各国打击新型犯罪的制胜法宝。刑事技术侦查措施就是指侦查机关针对某些特定犯罪,在用尽传统侦查手段难以侦查时,运用技术手段并受到法律规制,在犯罪嫌疑人不知情的情况下,获取证据材料的侦查措施。其具有秘密性、技术性等特征。在其运用时应遵守程序法定原则、比例原则等,并且应当平衡其与人权保障的关系。虽然我国刑事诉讼法明确的规定了刑事技术侦查措施,但有些规定比较模糊、空洞,难以具体操作,如审批程序不严格、适用范围不确定、适用期限没有上限等问题。通过考察域外刑事技术侦查措施的做法,美国、英国、德国、法国均对刑事技术侦查措施作出了详尽的规定,四国都对其案件的适用范围、期限、监督等作出了严格的规定,值得我们学习。笔者认为我国刑事技术侦查措施应当从以下几个方面进行完善,首先,审批程序应当更加细致化,并将审批工作交由检察院负责。其次,完善当事人的救济,建立长效的问责机制,并给予当事人知情权和救济的权利。接着,完善证据使用规定,细致规定材料转化成证据的标准和移送标准,并且应当严格规制刑事技术侦查措施的适用范围及条件。最后,明确刑事技术侦查措施的适用期限并建立严密的监督体系。
[Abstract]:The measures of criminal investigation have become a magic weapon to crack down on the new crime all over the world.The measure of criminal technical investigation refers to the investigation organ that aims at certain specific crimes, when it is difficult to investigate when the traditional investigation means are exhausted, and is regulated by law, when the suspect is not aware of the crime.Investigative measures for obtaining evidentiary materials.It has secret, technical and other characteristics.In its application, the principle of procedural law, principle of proportionality and so on should be observed, and the relationship between the principle and the protection of human rights should be balanced.Although the Criminal procedure Law of our country clearly stipulates the measures of criminal technical investigation, but some provisions are rather vague, empty, difficult to operate, for example, the examination and approval procedure is not strict, the scope of application is uncertain, and there is no upper limit for the application period and so on.By examining the practice of extra-territorial criminal investigation measures, the United States, Britain, Germany, and France have all made detailed provisions on criminal technical investigation measures. All four countries have made strict regulations on the scope, duration, and supervision of their cases.It is worth learning.The author thinks that the measures of criminal investigation should be improved from the following aspects: firstly, the examination and approval procedure should be more meticulous, and the examination and approval work should be handed over to the procuratorate.Secondly, improve the relief of the parties, establish a long-term accountability mechanism, and give the parties the right to know and the right to relief.Then, we should perfect the rules of evidence use, specify the standard of material conversion into evidence and transfer standard, and strictly regulate the applicable scope and conditions of criminal technical investigation measures.Finally, the application period of criminal technical investigation measures and the establishment of a strict supervision system.
