司法改革语境下合议庭独立审判问题研究

【摘要】：在全面深化司法体制与审判权运行机制改革的背景下,保障合议庭依法独立行使审判权、落实办案责任制已成共识。然而,司法实践中存在着较为普遍的审与判相分离,合议庭独立审判权得不到保障的现象。造成此种现象的原因在于法院独立审判而非合议庭独立审判的理论误区、法院内部权力结构的等级化以及外部因素的不当干扰。改革的方向是坚持合议庭独立行使审判权与落实合议庭独立承担责任。应当从规范院庭长的审判管理与监督权,排除地方权力对法院系统的干扰,严格规范现有审级监督形式,健全法官履职保障机制,畅通监督制约渠道以及完善合议庭责任承担机制等方面加强对合议庭独立审判权的保障。
[Abstract]:Under the background of comprehensively deepening the reform of the judicial system and the operating mechanism of judicial power, it has become a consensus to ensure the collegial panel to exercise its jurisdiction independently according to law and to implement the responsibility system for handling cases.However, there is a general separation of trial and judgment in judicial practice, and the independent jurisdiction of collegial panel is not guaranteed.The causes of this phenomenon lie in the theoretical misunderstanding of independent trial by the court rather than by the collegial panel, the hierarchy of the internal power structure of the court and the improper interference of external factors.The direction of the reform is to uphold the collegial panel to exercise its jurisdiction independently and implement the collegial panel to shoulder its responsibilities independently.We should standardize the trial management and supervision power of the president of the court, eliminate the interference of the local power to the court system, strictly standardize the existing forms of trial supervision, and perfect the guarantee mechanism for the judges to perform their duties.To strengthen the guarantee of the collegial panel's independent jurisdiction in the aspects of unimpeded supervision and restriction channels and perfecting the mechanism of the collegiate panel's responsibility.
