泛媒体审判论的法理分析

【摘要】：禁止媒体审判已经成为国际共识,但媒体审判有其自身的真实含义。在我国,对媒体审判问题的认识出现明显泛化现象,主要表现为:将媒体对司法案件的正常舆论反应泛化为媒体审判;将正当舆论监督特别是对司法机关的舆论监督泛化为媒体审判;将民意对案件的正常表达泛化为媒体审判;将媒体侵权泛化为媒体审判。本文认为,解决媒体审判问题的根本途径是继续深化司法改革,坚持法院审判的独立性,只有这样才能最终防范和消解媒体审判。
[Abstract]:No media trial has become an international consensus, but the media trial has real meaning of its own. In our country, understanding of the media trial problems obvious generalization phenomenon, the main performance is: the generalization of normal public reaction media on judicial cases for trial supervision of public opinion and the media; especially on the judicial supervision of public opinion generalization for the media public opinion on the case of the trial; the normal expression of generalization for the media trial; the media infringement generalization for the media trial. The author thinks that the fundamental way to solve the problem of the media trial is to continue to deepen the reform of the judiciary and the independence on the court trial, the only way to eventually prevent and digestion trial by media.
