第三人侵害银行客户财产权纠纷案的分析及启示

【摘要】:正客户在商业银行营业场所内受到第三人非法侵害的情形是长期存在且屡见不鲜的问题,由此银行要经常面对客户要求赔偿的请求和有关诉讼。本文以案例展开分析,就第三人侵害客户利益时银行的法律责任、应诉中注意的问题、如何预防侵害风险等做简要阐述。基本案情客户明文顺于2009年6月2日在A银行阳城支行解放路营业部办理银行卡存款转到存折上的手续,银行工作人员严重失职以及环境、设施、措施等方面的不完
[Abstract]:It is a long-standing and common problem that the client is illegally infringed by the third party in the commercial bank's business place, so the bank often faces the customer's request for compensation and related litigation. In this paper, the author analyzes the legal liability of the bank when the third party infringes on the customer's interests, the problems that should be paid attention to, how to prevent the risk of infringement and so on. The basic circumstances of the case, the customer was clear on June 2, 2009 at the A Bank of Yangcheng Branch Jiefang Road Business Department to handle the bank card deposit to deposit on the passbook, the bank staff serious dereliction of duty and the environment, facilities, measures and other aspects of the endless.
