论我国行政公益诉讼的受案范围

【摘要】:改革开放三十多年,我国经济突飞猛进。然而,只依靠市场来对经济进行调节已不能满足需要,其缺点也逐渐显现。因而,政府不断对人们的经济生活进行干涉,在保护人们的合法权益时,也导致人们的公共利益存在受到政府的行政职权危害的可能。而人们为了维护公共权利不受行政职权的干涉,因而开始逐步采用行政程序来对行政权的行使进行有效规范。不过,只依靠行政程序的规范作用并不能达到预期的目标,更需要科学有效的司法保障才能更加有效的保障人们的公共利益。不过,在我国传统意义上的诉权体系中,由于缺少有效的司法救济渠道,同时原告的缺乏以及受案范围的模糊,使得人们很难有效地维护公共利益。因而,公益诉讼成为人们维护公共利益的有效途径。本篇文章的选题正是出于这样的考虑,从司法保障的层面来对公共利益进行维护。通常情况下,制度的建立以及发展均是立足于科学的理论之上,而为了能够更好地维护人们的公共利益,同时对行政权的行使进行有效的监督,完善的行政公益诉讼体系必不可少,相应的制度也急需建立并完善。因此,科学的理论是基础,理论指导实践,实践检验理论,而为了使得行政诉讼理论能够得到完善,就要求我们不断完善相关的理论,从而构建起科学完善的行政公益诉讼体系,从而有效地对公民的合法的公共利益进行维护。本文试图从以下方面做一些有益的尝试:从理论的角度来对行政公益诉讼受案范围的建立进行了系统的剖析,同时对其意义进行了分析。在此之上,还结合我国的实际情况,对行政公益诉讼相关制度以及受案范围中的不足进行了彻底的分析,并对此提出了相关的建议。全文共分为六个部分:第一部分主要介绍行政公益诉讼受案范围的研究背景及研究意义以及本文采用的研究方法。第二部分主要对行政公益诉讼及行政公益诉讼受案范围的基本理论进行概述,其中包公益诉讼的内容及意义,行政公益诉讼受案范围的概念、特点以及其价值分析。第三部分主要分析了域外的一些国家关于行政公益诉讼理论基础并对我国的启发与借鉴意义。第四部分主要是结合我国《行政诉讼法》中关于受案范围的现行立法规定,对我国的公益诉讼受案范围中的不足进行了系统地剖析,并联系其相应的内容以及准则,第五部分对行政公益诉讼的受案范围,提出了一些具有可操作性的建议。第六部分是结论,总结全文的核心观点。本篇文章研究的核心内容是立足于我国行政公益诉讼的发展情况,对其中的不足,如立法方面等进行了彻底的分析,同时,并运用相关理论,综合文献研究以及价值分析两种方式,来全方位地介绍并分析了我国的行政公益诉讼,对其受案范围进行了系统地剖析,并在此基础上,提出了一些具有可操作性的建议。
[Abstract]:Reform and opening up for more than 30 years, China's economy by leaps and bounds. However, only relying on the market to adjust the economy can no longer meet the needs, its shortcomings have gradually emerged. As a result, the government constantly interferes with people's economic life, while protecting people's legitimate rights and interests, it also leads to the possibility that the public interests of people are endangered by the government's administrative power. In order to protect public rights from interference of administrative power, people began to use administrative procedure to regulate the exercise of administrative power. However, only relying on the normative role of administrative procedures can not achieve the desired goal, but also need scientific and effective judicial protection to protect people's public interests more effectively. However, in the traditional litigation system of our country, because of the lack of effective judicial relief channels, the lack of plaintiff and the ambiguity of the scope of the case, it is difficult for people to effectively safeguard the public interest. Therefore, public interest litigation has become an effective way for people to safeguard the public interest. The topic of this article is based on such considerations, from the level of judicial protection to safeguard the public interest. Usually, the establishment and development of the system are based on the scientific theory, and in order to better safeguard the public interests of people, at the same time, the exercise of executive power to carry on effective supervision, The perfect administrative public interest litigation system is indispensable, the corresponding system also urgently needs to establish and consummate. Therefore, the scientific theory is the foundation, the theory guides the practice, the practice tests the theory, but in order to make the administrative litigation theory to be able to be consummated, requires us to continuously consummate the related theory, In order to establish a scientific and perfect administrative public interest litigation system, and effectively safeguard the legitimate public interests of citizens. This paper attempts to do some useful attempts from the following aspects: from the theoretical point of view, the establishment of the scope of administrative public interest litigation cases is systematically analyzed, and its significance is analyzed. On this basis, combined with the actual situation of our country, this paper makes a thorough analysis on the relevant system of administrative public interest litigation and the shortcomings in the scope of receiving cases, and puts forward some relevant suggestions. This paper is divided into six parts: the first part mainly introduces the research background and significance of the scope of administrative public interest litigation cases and the research methods adopted in this paper. The second part mainly summarizes the basic theory of administrative public interest litigation and the scope of administrative public interest litigation, including the content and significance of public interest litigation, the concept, characteristics and value analysis of the scope of administrative public interest litigation. The third part mainly analyzes the theoretical basis of administrative public interest litigation in some foreign countries and enlightens and uses for reference for our country. The fourth part mainly analyzes the shortcomings of the scope of public interest litigation in our country by combining the current legislative provisions of the scope of accepting cases in the Administrative Litigation Law of our country, and connects with its corresponding contents and standards. The fifth part puts forward some operable suggestions on the scope of administrative public interest litigation. The sixth part is the conclusion, summarizes the core point of view of the full text. The core content of this article is based on the development of administrative public interest litigation in our country, and makes a thorough analysis of its shortcomings, such as legislative aspects, at the same time, using relevant theories. By synthesizing the literature research and value analysis, this paper introduces and analyzes the administrative public interest litigation in our country in all directions, and systematically analyzes the scope of accepting cases, and puts forward some operable suggestions on this basis.
