“剩余疑点”下的审判模式

【摘要】：“剩余疑点”是犯罪事实的当前证明状态与法定证明标准之间的“证明距离”。它使刑事审判产生了误判风险。从比较法角度而言,法院的应对方案可分为“接力赛模式”和“辩论赛模式”。两者均可以在一定程度上将剩余疑点的裁判风险控制在一个可接受的范围之内,且以一种相对确定的制度方案将降低误判风险和合理分配误判风险的策略予以法治化。我国剩余疑点风险控制方式可以概括为“职权裁量模式”。其核心问题是剩余疑点误判风险控制的不确定性。结合中国刑诉法的背景,应当从区别对待两种疑点、构建澄清疑点的保障机制和废止撤回起诉等方面合理规制裁判风险。
[Abstract]:"residual doubt" is the "proof distance" between the current state of proof of criminal fact and the legal standard of proof. It creates the risk of miscarriage of justice in criminal trials. From the point of view of comparative law, the court's coping scheme can be divided into "relay race mode" and "debate competition mode". Both of them can control the judgment risk of the remaining doubt within an acceptable range to a certain extent, and adopt a relatively determined system scheme to reduce the risk of miscarriage of justice and reasonably allocate the risk of miscarriage of justice. The risk control mode of residual doubt point in our country can be summed up as "power discretion mode". Its core problem is the uncertainty of risk control of residual misjudgment. Combined with the background of China's Criminal procedure Law, we should deal with the two kinds of doubts differently, construct the safeguard mechanism to clear up the doubts and abolish and withdraw the prosecution, and so on.
