从陕甘宁边区两个司法案例谈起

【摘要】：权源在人民,法源亦在人民,中国共产党在陕甘宁边区局部执政的基本政治立场,为建立人民司法制度创造了前提和条件。对封芝琴案和黄克功案的司法审判,既是陕甘宁边区推动人民群众直接参与司法、追求实质的平等和正义的生动实践与探索,也是党的思想路线和群众路线在陕甘宁边区法治建设中的具体体现。
[Abstract]:The basic political position of the Communist Party of China in the partial governance of the Shensi-Kansu-Ningsia Border region has created a prerequisite and condition for the establishment of the people's judicial system. The judicial trial of the Fengzhi Qin case and the Huang Kegong case is a vivid practice and exploration of promoting the people's direct participation in the administration of justice and pursuing substantive equality and justice in the Shensi-Kansu-Ningsia Border region. It is also the concrete embodiment of the Party's ideological line and mass line in the construction of the rule of law in the Shaanxi-Kansu-Ningxia Border region.
