反贪污贿赂侦查工作若干实务问题研究

【摘要】：文章以十八大以来我国掀起反腐风暴，反腐新形势对反贪侦查工作提出新的挑战为引，分三章论述反贪侦查实务三个核心工作问题，即发现线索问题、审讯谈话问题、侦查技术问题。文中，作者联系实务对上述三个问题分别作思考和研究，提出自己的观点和建议。第一章论述发现线索问题，作者分四节予以论述，第一节提出反贪案件线索的定义和特点；第二节把发现线索的途径分为六类；第三节提出发现线索工作主要存在的三个问题；第四节从七个方面提出发现线索能力建设的思考和建议。第二章论述审讯谈话问题，作者分“审讯室”和“审讯素材”两个主题分别论述，“审讯室”从辅助审讯效果的角度分五个方面提出构建思考，“审讯素材”分三节予以论述，第一节提出审讯素材的定义和特点，第二节提出研究审讯素材的意义，第三节就讯问中常用的诉讼阶段素材、法律政策素材、家庭亲情素材等三个审讯素材的内容及运用提出思考和建议。第三章论述侦查技术问题，作者分四节予以论述，第一节提出技术侦查的概念和特点，，第二节罗列技术侦查措施的种类，第三节分析侦查技术和技术侦查的主要区别，第四节就实践中常用的电话通信话单分析技术、手机通信定位技术、心理生理测试技术的原理和应用提出思考和建议。
[Abstract]:Based on the anti-corruption storm in China since the 18th National Congress of the CPC, and the new anti-corruption situation posing new challenges to the anti-corruption investigation work, the article discusses three core work issues in the practice of anti-corruption investigation in three chapters, namely, discovering clues, interrogating and talking. Technical problems of investigation In this paper, the author thinks and studies the above three problems with practice, and puts forward his own views and suggestions. The first chapter discusses the clue problem, the author divides it into four sections, the first section puts forward the definition and characteristics of the clue in the anti-corruption case, the second section divides the way of discovering the clue into six categories, the third section puts forward the three main problems in the work of discovering the clue. The fourth section puts forward some thoughts and suggestions on the construction of the ability to discover clues from seven aspects. The second chapter deals with the question of interrogation and conversation. The author discusses the two themes of "interrogation room" and "interrogation material" respectively. "interrogation room" is divided into five aspects from the angle of auxiliary interrogation effect, and "interrogation material" is discussed in three sections. The first section puts forward the definition and characteristics of the interrogation material, the second section proposes the significance of studying the interrogation material, the third section puts forward the common lawsuit stage material, the legal policy material in the interrogation. The content and application of three interrogation materials, family material, are put forward. The third chapter discusses the technical problems of investigation, the author discusses them in four sections. The first section puts forward the concept and characteristics of technical investigation, the second section lists the types of technical investigation measures, the third section analyzes the main differences between investigative techniques and technical investigations. The fourth section puts forward some thoughts and suggestions on the theory and application of telephone communication bill analysis technology, mobile phone communication location technology and psychophysiological testing technology.
