检察官员额制研究

【摘要】:检察官员额制是指检察机关在编制内根据本机关办案的数量、管辖区内的人口、本地的经济发展水平等因素来确定检察官的人员限额。如果员额一经确定,在相当的时间内不能改变,意味着没有缺额就不能替补。这一制度有深厚的法理基础,而且检察官员额制对我国司法改革有重要作用。检察官员额制改革是司法改革的重要内容,在实践中,我国检察官员额制改革存在一些问题,主要包括:一律规定39%的检察官入额上限不合理;检察官的入额条件存在问题,对检察官入额条件没有明确统一的规定;检察官的入额程序存在问题,检察人员的个人申报、入额的面试考察和公示程序,还有需要改进的地方;检察官遴选委员会的组织建设不完善,最为突出的是检察官遴选委员会内部构成不均衡;检察官的分类管理不健全;最后,检察官的权利保障机制不健全。针对检察官员额制存在的问题,本文提出了相应的完善建议。具体包括:确定合理的检察官入额比例,对人均办案数高的省份,可以突破39%的上限确定较高的员额比例;明确统一规定了思想政治条件、廉洁自律条件、年龄条件、学历条件、从业经历等方面的入额条件;通过干警推荐方式完善检察人员个人申报的入额程序,建立及时、全面、形式多样的入额检察官公示制度;完善检察官遴选委员会的组织建设,注重检察官遴选委员会人员构成的均衡性;加强检察官、检察辅助人员和司法行政人员等检察人员的分类管理;完善检察官职业保障机制、经济保障机制和人身安全保障机制等。
[Abstract]:The post system of procurators refers to the number of cases handled by the procuratorial organs, the population in the jurisdiction, the level of local economic development and other factors in the establishment of procuratorial organs to determine the personnel limit of prosecutors. If a post has been identified and cannot be changed for a considerable period of time, it means that no replacement can be replaced without a vacancy. This system has a deep legal foundation, and the post system of procurator plays an important role in the judicial reform of our country. The reform of the procurator post system is an important part of the judicial reform. In practice, there are some problems in the reform of the post system of procurators in our country, including the unreasonable ceiling of 39% of the procurators' entry quota, the problems in the conditions of the procurators' entry, and the problems in the reform of the procurator's post system. There is no clear and uniform stipulation on the condition of the procurator's entry; there are some problems in the procedure of the procurator's entry, the personal declaration of the procurator, the procedure of interview and inspection and the procedure of publicizing the amount of the procurator, and there are still some areas that need to be improved. The organization of the Public Prosecutor selection Committee is not perfect, the most prominent is the imbalance of the internal composition of the Public Prosecutor selection Committee; the classification and management of prosecutors is not perfect; finally, the protection mechanism of prosecutors' rights is not perfect. In view of the problems existing in the post system of procurators, this paper puts forward corresponding suggestions for perfection. Specifically, it includes: determining a reasonable percentage of procurators' intake; for provinces with a high number of cases handled per capita, they can break through the upper limit of 39% to determine a higher proportion of posts; clearly and uniformly stipulate ideological and political conditions, conditions for honesty and self-discipline, and conditions for age. The qualification of educational background, employment experience, and so on; improve the procedure of the procurator's personal declaration by the way of recommending by the cadres and police, and establish a timely, comprehensive and diversified system of public notice of the procurator. To improve the organization and construction of the procurator selection committee, pay attention to the balance of the composition of the procurator selection committee; strengthen the classified management of procurators, procuratorial assistants and judicial administrators; improve the mechanism of professional security for prosecutors; Economic security mechanism and personal security mechanism.
