我国民事案例指导制度的完善

【摘要】：我国案例指导制度的建立尚处于上升时期。就指导性案例目前的应用现状来讲,仍然存在许多问题。新型案件的出现使得指导性案例的制作数量有所提高,社会的进步使得案例指导制度的制作水平有所提高,但是案例制度设计的初衷是规范法律的统一适用,抑制法官自由裁量权的滥用,实现同案同判。然而,制度的运作总是与设计初衷有所偏离。本文笔者结合张骐、朱芒教授的观点,通过对案例指导制度的现状探究以及制度描述,详细指出了案例指导制度所面临的各种问题,并且对应给出这些问题的解决方案,以期给制度的建设指明正确的方向。制度的建设要把制度内部的运作和外部环境相结合,作者试图分析案例指导制度的内外部问题,分别给出两方面的解决思路,只有这样制度的定位才能全面而清晰,制度的遴选才能详尽而彻底。
[Abstract]:The establishment of case guidance system in China is still on the rise. There are still many problems in the application of instructive cases. The emergence of new cases has increased the number of guiding cases, social progress has improved the production level of the case guidance system, but the original intention of the case system design is to standardize the unified application of the law. Restrain the abuse of the judge's discretion and realize the same judgment in the same case. However, the operation of the system always deviates from the original design. Based on the views of Professor Zhang Vernon and Professor Zhu Mang, the author points out in detail the various problems faced by the case guidance system by exploring the present situation of the case guidance system and the system description, and gives corresponding solutions to these problems. With a view to the construction of the system to point out the correct direction. The author tries to analyze the internal and external problems of the case guidance system and give two solutions respectively. Only in this way can the positioning of the system be comprehensive and clear. The selection of the system can be exhaustive and thorough.
