民事当事人申请检察监督程序研究

【摘要】:2012年新《民事诉讼法》将民事检察监督的范围由原来的“民事审判活动”延伸为“民事诉讼”,扩展了检察机关的检察监督范围。法律首次赋予民事当事人申请检察监督的权利,畅通申请途径,,规范了申请内容。当事人可以向检察院申请对再审的检察监督、申请对执行活动的检察监督、申请对审判过程中审判人员违法行为的检察监督。本文以民事当事人申请检察监督问题为研究内容,通过论证民事当事人申请检察监督程序的理论基础及立法状况,试图指出申请检察监督程序中存在的立法及实践缺陷,旨在寻找合理的完善建议,同时也是对未来法律的修改及司法解释的出台的一种展望。 本文除序言和致谢外,分为三个部分,主要内容介绍如下: 第一部分,我国民事当事人申请检察监督程序的理论基础及立法现状。首先,介绍检察监督原则及检察监督权能的基本内容,从理论出发,引出当事人申请检察监督程序构建的法律价值,分析其存在的合理性。认为当事人申请检察监督法律程序符合程序安定性、实体公正、程序正义、增进效率等价值的基本要求。然后,以新民诉法的修改为背景,分析当前关于当事人申请检察监督的立法现状。 第二部分,我国民事当事人申请检察监督程序存在的问题。从两个方面出发,一是当事人申请程序中存在的问题,二是检察机关对申请的受理中存在的问题。在当事人申请检察监督的程序中,首先,“先法后检”的程序设计由于立法仓促存在缺陷,其次,对当事人申请检察监督的时限法律未作出明确规定,再次,分析当事人申请执行监督程序中存在的问题,最后,分析当事人申请对审判人员违法行为监督程序中存在的问题。在检察机关受理当事人的申请程序中,工作机制不完善,检察建议效力较低是当前较为明显的问题。 第三部分,完善我国民事当事人申请检察监督程序的建议。在前两部分的基础上,笔者通过分析提出自己的建议。针对申请程序和受理程序中的诸多问题,对症下药,完善当事人申请检察监督程序的立法设计,规范检察机关受理申请的工作机制,提高检察建议的实效。畅通当事人申请检察监督的途径,增强检察监督的实效,保障民事当事人的合法权利,维护司法公正。
[Abstract]:In 2012, the new law of civil procedure extends the scope of civil procuratorial supervision from the original "civil trial activities" to "civil litigation", which extends the scope of procuratorial supervision of the procuratorial organs. The law gives the civil litigants the right to apply for procuratorial supervision for the first time, unimpeded application ways, and rules the application content. The parties may apply to the procuratorate. The procuratorial supervision of the retrial, the application of procuratorial supervision of the execution activities and the application of the procuratorial supervision on the illegal acts of the judges during the trial process. This article attempts to point out the application of the procuratorial supervision through the argument of the civil litigants' application for procuratorial supervision and the theoretical basis and legislative status of the civil litigants' application for procuratorial supervision procedures. The legislative and practical defects in the governor's procedure are aimed at finding reasonable suggestions for perfection, and also a prospect for the revision of the future law and the introduction of judicial interpretation.
In addition to preface and acknowledgement, this article is divided into three parts. The main contents are as follows:
The first part is the theoretical basis and the legislative status of the civil litigants applying for procuratorial supervision procedure in China. First, it introduces the basic contents of the principle of procuratorial supervision and the power of procuratorial supervision. From the theory, it leads to the legal value of the party applying for the construction of the procedure for procuratorial supervision and the analysis of the rationality of its existence. The law procedure conforms to the basic requirements of the value of the stability of the procedure, the justice of the entity, the justice of the procedure, the enhancement of the efficiency and so on. Then, with the revision of the new civil procedure law as the background, the current legislation on the application of procuratorial supervision to the parties is analyzed.
The second part, the problems existing in the procedure for procuratorial supervision of civil litigants in our country. From two aspects, one is the existing problems in the application procedure of the parties, and the two is the problems in the acceptance of the application. In the procedure of applying for procuratorial supervision by the parties, first, the procedural design of "first law and post inspection" is due to the hasty legislation. In the second place, the time limit of the party's application for procuratorial supervision has not made a clear provision. Again, it analyses the problems existing in the application of the supervision procedure of the parties. Finally, it analyzes the problems existing in the application of the litigant to the judicial personnel's illegal behavior supervision procedure. In the application procedure of the procuratorial organs, the working mechanism of the application of the parties to the parties is accepted. Imperfect, the low effectiveness of procuratorial suggestions is a more obvious problem at present.
The third part, perfect our country's civil litigant to apply for the procedure of procuratorial supervision. On the basis of the first two parts, the author puts forward his own suggestion through analysis. In view of the many problems in the application procedure and acceptance procedure, the author tries to improve the legal design of the party's application for procuratorial supervision procedure and standardize the application of the procuratorial organ. Make a mechanism to improve the effectiveness of the procuratorial proposal, unimpeded the way the parties apply for procuratorial supervision, enhance the effectiveness of the procuratorial supervision, guarantee the legal rights of the civil parties and safeguard the justice of the judiciary.
