死刑复核程序中辩护权的保障研究

【摘要】：死刑复核程序在控制和限制死刑方面发挥着重要功能,而实现这一功能最为关键的便是辩护权的有效行使。辩护权作为维护被告人权益的手段之一,广泛存在于各种刑事案件的审判程序中,它不仅是法律赋予被告人的权利,也是体现审判程序公平公正的保证。在死刑复核程序赋予被告人以辩护权,使律师有效参与死刑复核程序,充分表达被告人的诉求,对死刑被告人具有极为重要的意义。2007年最高人民法院将死刑核准权收回后,相继出台了一系列的法律法规政策,对死刑复核程序中的辩护权加以规定,使死刑被告人辩护权的行使有了初步的保障。但就现阶段的情况来看,死刑被告人辩护权在死刑复核程序中的行使还存在诸多障碍,例如,死刑复核程序的定位不明,影响着复核程序的审核方式;辩护权立法不完善,对被告人和辩护律师在参与复核程序,行使具体权利以及权利受到侵害时的救济等方面存在不足。在司法实践中,复核死刑的人民法院受到以上诸多因素的影响,存在排斥辩护权的介入、妨碍辩护权有效行使的情况,无法实现死刑复核程序的功能。基于我国死刑程序中辩护权的行使保障不足、缺乏实效的问题,应在明确死刑复核程序定位的基础上,从以下几个方面完善保障辩护权有效行使的程序制度。首先,明确被告人和辩护律师在死刑复核程序中的地位以及享有的具体的辩护权,为被告人和辩护律师参与死刑复核程序提供坚实的基础。其次,通过实体与程序措施保障辩护权被侵害时的救济,使得被告人和辩护律师在辩护权行使受阻以及无法行使的情况下,获得必需的救济措施。最后,检察机关亦应承担辩护权的保障职能,通过法律监督对被告人辩护权的有效行使予以保障。
[Abstract]:The death penalty review procedure plays an important role in controlling and restricting the death penalty, and the key to the realization of this function is the effective exercise of the right to defend the defense. The right to defense, as one of the means to safeguard the rights and interests of the defendant, is widely used in the trial procedure of various criminal cases. It is not only the right given by the law to the defendant, but also the embodiment of the trial. The procedure of the review of the death penalty gives the defendant the right to defend the defendant, make the lawyer participate in the procedure of rechecking the death penalty effectively, fully express the appeal of the defendant, and have great significance to the defendant of the death penalty. Based on the lack of guarantee and the lack of actual effect in the execution of the death penalty procedure in our country, the procedural system for the effective exercise of the right to defend the defense should be perfected on the basis of the definition of the procedure for the review of the death penalty. First, it is clear that the defendant and the defense lawyer are in the procedure of the death penalty review. The status and the specific right to defense provide a solid foundation for the defendants and defense lawyers to participate in the procedure for the review of death penalty. Secondly, through substantive and procedural measures to ensure the relief of the right to defend the right of defense, the defendant and the defence lawyer obtain the necessary relief measures when the exercise of the right of defence is blocked and the law is not exercised.
