论家事非讼程序

【摘要】：司法权包括争讼裁判权和非讼裁判权。非讼裁判权应是民事裁判权项下一种相对独立的权利。然而,在我国,民事程序法一直是将诉讼程序作为中心制度,非讼程序是一个长期被忽视的问题。我国也没有针对家事事件本身的特性构建独立的家事审判程序,包括家事非讼程序。这既不能因应现代社会的司法需求,也和世界各国或地区纷纷建立起家事非讼程序制度的潮流不符,在一定程度上也制约了我国民事程序制度的发展和进步。本文基于对家事审判制度特殊性的思考,而赞成区分规定家事诉讼程序和家事非讼程序。本文拟在参考其他国家或地区的相关制度规定的基础上,就家事非讼程序的基本理念、基本原则以及该程序制度的一些特殊问题进行深入探讨。
[Abstract]:The judicial power includes the power of contentious adjudication and the power of non-litigation adjudication. Non-litigation jurisdiction should be a relatively independent right under civil jurisdiction. However, in our country, the civil procedure law always regards the lawsuit procedure as the central system, the non-litigation procedure is a long-term neglected problem. There is no independent family trial procedure, including family non-litigation procedure, according to the characteristics of family affairs in China. This can not meet the judicial needs of modern society, but also with the world countries or regions have established the trend of non-litigation system, to a certain extent, has also restricted the development and progress of the civil procedure system in China. Based on the particularity of the family trial system, this paper is in favor of distinguishing the family litigation procedure from the family non-litigation procedure. On the basis of referring to the relevant regulations of other countries or regions, this paper makes a thorough discussion on the basic concept, basic principles and some special problems of the non-litigation procedure of family affairs.
