【摘要】：正民事行政检察主要为事后监督,案件审查方式以书面审查为主,主要依托于申请人提供材料和法院卷宗等,但事实认定错误或审判、执行活动违法等问题,经常需要通过调查核实来进行评判。民事诉讼法和最高人民检察院《人民检察院民事诉讼监督规则(试行)》(以下简称《监督规则》)对民事调查核实权进行了规制。一、民事调查核实权适用的法律困境1.调查核实措施存在一定的弱质性。依《监督规则》规定,拒绝或妨碍调查核实的,可向有关单位或
