浅议我国刑事速裁制度的构建与发展

【摘要】：当前,我国的经济社会正处于发展的转型期和改革的深水区,经济发展模式的转换、体制的深层次的改革和更加全方位的对外开放,正在加速着我国的社会转型,这不但是给我国的经济社会发展提供了重要的战略机遇,而且也使我国累积的社会矛盾日益凸显出来。特别是近几年来各类刑事犯罪案件逐年增多,呈现几何增长趋势,这不仅严重威胁了广大人民群众生命和财产安全,使我国的经济社会发展蒙受了诸多的不良影响和重大损失,而且使得我们的诉讼成本不断增加,有限的司法资源分配变得日趋紧张。因此,如何改进和完善我国的刑事诉讼程序,促进案件的繁简分流、促进司法资源配置的合理与优化,进一步提升司法之效率、保障审判之质量,以来更好地保障当事人的基本人权、维护当事人的合法权益,维护社会的和谐与稳定,就成为了我国司法改革的一项紧迫的重要任务,刑事速裁制度便应运而生。目前,我国的刑事速裁制度还是诉讼程序上的简化,且还处在试点阶段,完整的制度体系还尚未构建完成。本文试图通过对我国刑事速裁制度的构建背景及构建意义、发展之缘起和当前的理论与实践之探索等方面进行研究分析,并结合国内外经验之借鉴,对我国刑事速裁制度的构建和完善方面,在刑事速裁程序的适用范围、在立案侦查阶段到审判阶段的诉讼流程各阶段的适用上、以及律师和当事人基本权利保障方面提出自己的构建设想和观点建议,以期能为我国当下之司法改革提供些许的参考。
[Abstract]:At present, China's economy and society are in the transition period of development and the deep water area of reform, the transformation of economic development mode, the deep level reform of the system and the opening to the outside world in all directions are accelerating the social transformation of our country. This not only provides an important strategic opportunity for the economic and social development of our country, but also makes the social contradictions accumulated in our country increasingly prominent. In particular, in recent years, various kinds of criminal cases have increased year by year, showing a geometric growth trend. This not only seriously threatens the lives and property safety of the broad masses of the people, but also causes many adverse effects and heavy losses to the economic and social development of our country. Moreover, our litigation costs are increasing, and the allocation of limited judicial resources is becoming increasingly tight. Therefore, how to improve and perfect the criminal procedure of our country, to promote the complicated and diffused cases, to promote the rational and optimized allocation of judicial resources, to further improve the efficiency of the administration of justice, and to ensure the quality of the trial. Since then, it has become an urgent and important task to protect the basic human rights of the parties, safeguard the legitimate rights and interests of the parties, and maintain the harmony and stability of the society. At present, the criminal adjudication system of our country is still the simplification of litigation procedure, and it is still in the pilot stage, and the complete system has not yet been completed. This paper attempts to study and analyze the background and significance of the construction, the origin of the development and the exploration of current theory and practice of the criminal quick adjudication system in our country, and combine the experience of domestic and foreign countries for reference. In terms of the construction and perfection of the criminal quick adjudication system in our country, the scope of application of the criminal quick adjudication procedure and the application of each stage of the litigation process from the investigation stage to the trial stage, As well as lawyers and parties to the basic rights of the protection of their own ideas and ideas, in order to provide some reference for the current judicial reform in China.
