诉讼秩序视野下法官职业权益保障研究

【摘要】：良好的诉讼秩序对于公正审判,维护当事人的合法权益具有至关重要的作用,而法官是整个诉讼秩序的指挥者,法官的职业权益得不到保障势必会影响整个诉讼活动的顺利进行。当前我国法官职业权益保障制度还存在许多不完善之处,立法保障不完备,技术保障不足,社会保障欠缺,经济保障缺失等等。本文笔者将法官职业权益的保障放在诉讼秩序视野下进行研究,对诉讼秩序做出了阐释,这利于诉讼秩序中法官职业权益保障范围的确定。本文重点探讨了如何从立法、技术、社会、经济层面对我国法官职业权益进行保障并完善,认为立法上扩大扰乱法庭秩序罪的适用范围更具合理性,设立专有针对侵害法官权益的罪名没有必有,但可以加大惩处侵害法官职业权益的力度;技术层面上提出加强法院场域外与法院场域内全方位的保护;社会层面上加大法制宣传,规范新闻媒体报道,提高全民敬法、守法的意识;经济层面上提出要切实提高法官的福利待遇,构建特殊的人身保险制度与经济补偿制度,帮助法院转移风险,增强法官抵御风险的信心,激励法官的奉献精神。
[Abstract]:A good litigation order is of vital importance to a fair trial and safeguarding the legitimate rights and interests of the parties concerned, and the judge is the commander of the entire litigation order. The lack of protection of the professional rights and interests of judges will inevitably affect the smooth progress of the entire litigation activities. At present, there are still many imperfections in the protection system of the professional rights and interests of judges in our country, such as imperfect legislative protection, insufficient technical security, lack of social security, lack of economic security and so on. In this paper, the author puts the protection of the professional rights and interests of judges in the perspective of litigation order to make an interpretation of the procedural order, which is conducive to the determination of the scope of the protection of the professional rights and interests of judges in the litigation order. This paper focuses on how to protect and perfect the professional rights and interests of judges in our country from the aspects of legislation, technology, society and economy, and thinks that it is more reasonable to expand the scope of application of the crime of disturbing the order of the court in legislation. The establishment of exclusive crimes against the rights and interests of judges does not necessarily exist, but can increase the punishment of infringement of judges' professional rights and interests; At the social level, we should increase the publicity of the legal system, standardize the news media reports, raise the awareness of the whole people to respect the law and abide by the law; at the economic level, we should earnestly improve the welfare treatment of judges, and construct a special personal insurance system and an economic compensation system. To help the court transfer risks, enhance the confidence of judges to resist risks, encourage the dedication of judges.
