司法行为规范化的构建路径

【摘要】：司法行为规范化建设作为司法机关的一项基础性工作,日益受到理论界和实务界的关注和重视。随着能动司法的提出、软法的兴起和风险社会的发展,如何以新的视角来审视司法行为规范化成为司法机关面临的现实问题。需要从理论和实践层面上来认识司法行为规范化,以确定其基础、方向、突破口、重点等,以此把握其基本发展趋势更具务实性。
[Abstract]:As a basic work of the judiciary, the standardization of judicial behavior has been paid more and more attention by the theorists and the practitioners. With the development of active justice, the rise of soft law and the development of risk society, how to examine the standardization of judicial behavior from a new perspective has become a realistic problem facing the judicial organs. It is necessary to understand the standardization of judicial behavior from the theoretical and practical aspects in order to determine its basis, direction, breakthrough and emphasis, so as to grasp its basic development trend more practical.
