论职务犯罪信息化初查模式的构建

【摘要】：虽然职务犯罪在整个刑事犯罪中只占了很小的比例,但查办职务犯罪直接关系到党和国家的生死存亡。从这些年来国际上普遍采用的指标来看,我国的排名都比较靠后,腐败现象整体还相当严重。虽然十八大以来,党和国家对腐败一直保持高压态势,查办了一批大案要案,但腐败增量没有得到有效的遏制,这与群众的期望还有一定的差距。许多隐藏在群众身边的腐败分子没有被查处,与当前落后的初查模式有很大的关系。新时期,职务犯罪初查工作应当借助最新的社会发展成果,构建新的初查模式,提高初查能力,强化对职务犯罪的打击力度,营造风清气正的社会氛围,赢得群众的支持。根据社会信息化发展趋势及职务犯罪的侦查规律,可以判断信息化初查是未来职务犯罪初查模式的发展方向。信息化初查在发现线索、初查措施、初查效率、预测犯罪等方面具有传统初查模式无法比拟的优势,本文通过四个部分,全面对信息化初查进行分析和探讨,以期能为我国建立高效的职务犯罪初查模式提供理论依据,使我国查办职务犯罪工作更进一步。第一部分是信息化初查模式的概念界定。信息化初查是一个新生事物,本文从职务犯罪初查制度的产生开始,对职务犯罪初查制度进行了梳理,理清了初查制度的发展历史,并根据已有的研究成果,提出信息化初查模式的概念及其所具有的特征。第二部分是信息化初查模式必要性及可行性分析。职务犯罪初查工作作为社会物质生活的一部分,其发展变化必然受到社会发展变化的制约和影响。目前的职务犯罪初查模式已经无法适应社会信息化的发展,无法符合保障人权的法律法规,更不能应对职务犯罪的新变化,也无法满足打击职务犯罪的新要求。可行性方面,主要介绍最近几年职务犯罪初查工作的发展状况,这些发展奠定了信息化初查模式的基础。第三部分是信息化初查模式的域外经验借鉴。我国的犯罪信息化侦查工作发展起步较晚,有许多问题需要解决,本部分通过介绍香港、英国、美国在犯罪信息化侦查方面的运行模式、特点,并对进行比较研究,以期获得一些启示,为构建我国职务犯罪信息化初查模式提供借鉴。第四部分是信息化初查模式的具体构想。本部分是本文的重点,以构建我国职务犯罪信息化初查模式为出发点,结合实务工作经验,分别从制定支持信息化初查模式的法律法规、建设情报信息平台、加强组织支持力度、健全专业化人才培养机制、完善信息化初查工作机制五个方面入手,提出构建信息化初查模式的具体构想。另外,在这一部分的最后,重点还强调了在信息化初查过程中还应强化对公民隐私权的保护。
[Abstract]:Although the duty crime only accounts for a very small proportion in the whole criminal crime, the investigation and handling of the duty crime is directly related to the life or death of the Party and the country. Judging from the commonly used indexes in recent years, our country's ranking is relatively low, and corruption is still quite serious as a whole. Although the Party and the state have maintained a high pressure on corruption since the 18th National Congress, they have investigated and handled a number of major cases, but the increase in corruption has not been effectively contained, which still falls short of the expectations of the masses. Many of the corrupt elements hidden around the masses have not been investigated and have much to do with the current backward initial investigation model. In the new period, the initial investigation of job-related crimes should benefit from the latest achievements of social development, construct a new mode of initial investigation, improve the ability of initial investigation, strengthen the crackdown on job-related crimes, create a social atmosphere of clearing up the wind and clear the spirit, and win the support of the masses. According to the development trend of social informatization and the law of investigation of duty crime, it can be judged that the initial investigation of information is the developing direction of the mode of initial investigation of duty crime in the future. The information preliminary investigation has incomparable advantages over the traditional initial investigation mode in the aspects of clues, measures, efficiency, crime prediction and so on. This paper, through four parts, comprehensively analyzes and discusses the preliminary investigation of information technology. The aim is to provide the theoretical basis for the establishment of an efficient initial investigation mode of duty crime and to make the investigation of duty crime in our country go further. The first part is the definition of the initial survey mode of information technology. The initial investigation of information is a new thing. This paper begins with the emergence of the system of initial investigation of duty crime, combs the system of initial investigation of duty crime, clarifies the development history of the system of initial investigation, and according to the existing research results, This paper puts forward the concept and characteristics of the initial survey mode of information technology. The second part is the necessity and feasibility analysis of the initial investigation mode of information technology. As a part of social material life, the initial investigation of job-related crimes is bound to be restricted and influenced by social development and change. The current initial investigation mode of job-related crime has been unable to adapt to the development of social information, can not meet the protection of human rights laws and regulations, not to mention the new changes in job-related crime, nor can it meet the new requirements of cracking down on job-related crimes. In terms of feasibility, this paper mainly introduces the development of the initial investigation of job-related crimes in recent years, which has laid the foundation of the initial investigation mode of information technology. The third part is the overseas experience of the initial investigation mode of information technology. The development of crime information investigation in our country is relatively late, and there are many problems to be solved. This part introduces the operation mode and characteristics of Hong Kong, Britain and the United States in the field of crime information investigation, and makes a comparative study on it. In order to obtain some enlightenment, for our country duty crime information preliminary investigation mode provides the reference. The fourth part is the concrete conception of the initial investigation mode of information technology. This part is the focal point of this paper, starting from the construction of the initial investigation mode of the information of duty crime in our country, combining the practical work experience, separately from making the laws and regulations supporting the initial investigation mode of the information, building the information platform, In order to strengthen organizational support, perfect the training mechanism of specialized talents and perfect the working mechanism of information initial inspection, this paper puts forward the concrete conception of constructing the initial investigation mode of information technology. In addition, at the end of this part, the emphasis is also put on strengthening the protection of citizens' right to privacy in the process of initial information investigation.
