检察公信力评估指标体系及其优化

【摘要】：公信力的评估作为一个将理论量化的实践活动,可以更加直观且更加理性的对现有的司法公信力进行客观评价。在实际操作中运用量化评估体系,建立一种评估模型与数据,进而实现对评估结果的研究,这也是我国司法改革的一大步。党的十八大提出要加强我国司法公信力建设,提高我国司法公信力水平,真正实现“让人民群众在每一个案件中都感受到公平正义”。随着我国司法改革的推进,检察公信力评估作为一个重要方面,得到越来越多的重视。检察机关作为司法改革的一部分,所赖以存在的最重要的一点就是它的公信力,也就是它存在的必要性问题。随着我国经济、文化的发展,检察工作也在随之调整,以期追求社会效果、政治效果、法律效果的统一。在司法改革的大背景下,检察公信力评估是对检察工作与人民群众血肉联系的连接点,也是检察工作所要到达的最终目的,即“每个人的公平正义”。现今检察公信力的发展由于众多原因,处于不被量化或者无法量化、量化不准确的状态。因此造成检察公信力指标体系构建的阻碍,这需要在不断地试点和实践中逐步优化。在本文中,笔者从五个方面讨论了指标体系的优化,包括主体参与、指标的科学设计、执法办案考评体系的参考作用、指标体系的实践性以及科学设计指标的权重。围绕着我国检察公信力评估指标体系构建的问题,加以梳理和升华,以期为我国检察公信力评估指标体系的建设出一份力。对检察公信力的深入了解必须以理清检察公信力的本身内涵为前提。在对检察公信力进行评估时,科学建设指标体系才是保障最终结果有效性的关键。而如何对指标体系进一步优化是现行指标体系建设中的重中之重。科学有效的指标体系能够进一步提升检察公信力,加快我国检察公信力的建设。在我国检察公信力评估体系建设中,应借鉴国内部分地方成功经验,并从司法改革这个大方向努力,充分考虑司法体制本身、国家政策以及社会利益趋向,以实现我国司法改革的目的,加强社会公众对于检察系统的信任。本文的整体架构包括四个大部分,分别为引言、检察公信力评估指标体系概述、检察公信力评估指标体系的构建、检察公信力指标体系的问题及优化。第一部分是引言。引言分为三个部分:选题背景与意义、国内外的研究现状和研究方法与创新。检察公信力评估在我国司法改革的大背景下进行,本文中,选取最高检项目小组制定的三级指标体系进行研究,并借鉴国外研究相关经验。运用定量定性、分析研究方法与文献研究的方法,通过对我国检察公信力指标体系的具体建设分析,以及通过调查文献力求全面真实的掌握所要研究的问题。第二部分是对检察公信力评估指标体系概述进行写作,评估在一定程度上是对检察公信力的深层次挖掘,更是将检察公信力以一种相对量化的方式展现在人们的面前,以此促进检察工作公平公正的进行。本文从检察公信力是如何的定义的方面入手,检察公信力是什么、有什么特性、以及该如何进行评估。再从检察公信力评估的特性以及评估方法着手,进而对检察公信力指标体系的特性、作用做出阐述。第三部分是检察公信力评估指标体系的构建。文中首先提出了指标体系设置的必要性。进而指出当下检察公信力评估指标体系构建的基本进路,包括系统性、可行性、概括性、科学合理性精炼简便性的构建原则,以办案质量为核心、以办案人员为主要对象、具有中国特色的第三方评估为构建标准,以及指标体系的构建的宏观内容。在对现有指标体系的具体构建以及相关学者对于指标建设的看法进行了比较分析中,为第四部分中检察公信力评估指标体系的问题及优化的写作做出铺垫。第四部分是检察公信力指标体系的问题及优化。从指标体系的合理化角度分析这些既存指标体系所存在的问题,包括由于观念差异或者指标太本身的原因而导致指标设置的偏主观性,在设置指标时,所量化的内容有限以及指标体系建设时受到内外机制的影响、依据标准不一、指标权重设置不完善。本文针对这些问题对进行了相应探索。
[Abstract]:As a practical activity of quantifying the theory, the evaluation of public credibility can be more intuitive and more rational to evaluate the existing judicial credibility objectively. In practice, a quantitative evaluation system is used to establish an evaluation model and data, and then to study the evaluation results. This is also a big step in China's judicial reform. The Eighteenth National Congress of the Communist Party of China proposed to strengthen the construction of judicial credibility in China, improve the level of judicial credibility in China, truly realize "let the people feel fair and just in every case." With the promotion of China's judicial reform, the evaluation of procuratorial credibility as an important aspect, has received more and more attention. With the development of economy and culture in China, procuratorial work has been adjusted accordingly in order to pursue the unity of social, political and legal effects. It is the connection point between procuratorial work and the people's flesh and blood, and also the ultimate goal of procuratorial work, that is "everyone's fairness and justice". In this paper, the author discusses the optimization of the index system from five aspects, including the participation of the main body, the scientific design of the index, the reference function of the law enforcement case handling evaluation system, the practicality of the index system and the weight of the scientific design index. The construction of the index system should be sorted out and sublimated in order to make a contribution to the construction of the evaluation index system of procuratorial credibility in China. How to further optimize the index system is the most important in the construction of the current index system. A scientific and effective index system can further enhance the credibility of procuratorial work and speed up the construction of the credibility of procuratorial work in China. The overall framework of this paper includes four parts, namely, the introduction, the summary of the evaluation index system of procuratorial credibility, and the evaluation of procuratorial credibility. The first part is the introduction. The introduction is divided into three parts: the background and significance of the topic, the research status at home and abroad, and the research methods and innovations. The second part is the evaluation of procuratorial credibility. To some extent, the evaluation is a deep excavation of procuratorial credibility, but also a relatively quantitative way to show the public credibility of procuratorial work in front of people, in order to promote the fair and just conduct of procuratorial work. The third part is the construction of the evaluation index system of procuratorial credibility. The paper first puts forward the necessity of setting up the index system. At present, the basic approach to the construction of the evaluation index system of procuratorial credibility includes the principles of systematicness, feasibility, generality, scientific rationality, refining and simplicity, taking the quality of handling cases as the core, the personnel handling cases as the main object, the third-party evaluation with Chinese characteristics as the construction standard, and the macroscopic content of the construction of the index system. This paper makes a comparative analysis of the concrete construction of the existing index system and the opinions of relevant scholars on the construction of the index system, paving the way for the problems and optimization of the evaluation index system of procuratorial credibility in the fourth part. The fourth part is the problems and optimization of the index system of procuratorial credibility. These existing indicators system problems, including due to differences in concepts or indicators too own reasons leading to the subjectivity of the setting of indicators, in the setting of indicators, the quantitative content is limited and the construction of the indicators system is affected by internal and external mechanisms, according to different standards, the setting of indicators weight is imperfect. Problems were explored accordingly.
