论侦查人员的程序证人身份

【摘要】：司法改革的不断发展促成了刑事公诉之"诉"的多元化,侦查人员在不同的"诉"中也相应表现出了不同的证人身份。在程序合法性之诉中,侦查人员的实体证人身份随着程序进程逐渐向程序证人身份转化,这种程序证人身份的实质则是程序之诉中的被告。这种二元身份的特点集中体现在回避和作证等问题上。虽然侦查人员作为被告乃程序合法性之诉中的当事人,但是其在缺席审判、申请回避以及获得上诉救济等方面却不具有实体之诉中被告人享有的相应权利。从侦查人员的多重身份这一程序元素反映出程序之诉虽然在一定程度上独立于实体之诉,但其本质上仍是一个"迷你审判"程序,程序之诉的完全独立性有待于司法改革和理论研究的探索和拓展。
[Abstract]:The constant development of the judicial reform has promoted the diversification of the "suit" of the criminal prosecution, and the investigators have also displayed different witness identities in different "lawsuits". In the litigation of procedural legality, the substantive witness identity of the investigator is gradually transformed into the procedural witness identity with the procedure process, and the essence of the procedural witness identity is the defendant in the procedural lawsuit. The characteristics of this dual identity are embodied in the problems of avoidance and testimony. Although the investigator is the litigant in the lawsuit of procedural legality, he does not have the corresponding rights of the defendant in the substantive suit in the aspects of trial in absentia, application for withdrawal and obtaining appeal relief. The procedural element of the multiple identities of the investigators reflects that although the procedural action is somewhat independent of the substantive one, it is still essentially a "mini-trial" procedure. The complete independence of procedural litigation needs to be explored and expanded by judicial reform and theoretical research.
