论刑事侦查中电子数据的提取与固定

【摘要】：随着互联网的快速发展,我国面临越来越复杂的网络安全形式。网络是虚拟的,看不见、摸不着的,其中存储、运输的大量数据均为以电子形式存在,因此在大量刑事案件的侦查中不可避免的要调取大量电子数据。我国2012年修订的《刑事诉讼法》中将"电子数据"作为一种独立的证据纳入法定证据类型,这为刑事案件侦查中提取电子数据提供了有力的支撑。本文分为四个部分进行论述,第一部分对电子数据概念及分类进行陈述。第二部分讨论电子数据的收集模型。通过分析学界对取证模型的讨论,结合我国司法实践,论述了笔者认为较为合理的取证模型。第三部分主要探讨电子数据收集提取方法,这是本篇论文的重点。在刑事案件侦查中电子数据的收集既要充分利用传统的侦查手段,又要使用其与传统证据不同的新型取证侦查手段,传统取证手段主要论述了搜查、犯罪现场勘查、直接调取电子数据,新型的收集手段论述了电子数据勘验、网络在线提取及网络监听监控等措施。第四部分是对电子数据收集后的保管固定手段进行的分析。一般的证据,其保管过程较为简单,通过密封、封存保证物没有物理上的变化即可。但是电子数据具有虚拟性,无形性、易变性的特点,这就使电子数据的保管固定变的十分的重要。因此,电子数据的固定除了有一般证据的保管方法外还有其独特的固定方法。本文主要讨论几种主要的电子数据固定方法,有扣押、封存、备份、冻结、计算完整性校验值、拍照、打印、录像等。对于上述几种固定方法,冻结电子数据以及计算完整性校验值是在刑事侦查中较为新颖的固定证据的方法,因此本文将重点论述这两种固定方式的适用情形、适用方法,以及在实践中遇到的问题。
[Abstract]:With the rapid development of the Internet, our country faces more and more complex network security forms. The network is virtual, invisible and untouchable, in which a large number of data stored and transported exist in electronic form, so it is inevitable to obtain a large number of electronic data in the investigation of a large number of criminal cases. In our country's Criminal procedure Law revised in 2012, "electronic data" is taken as an independent evidence into the legal evidence type, which provides a strong support for the extraction of electronic data in criminal case investigation. This paper is divided into four parts, the first part of the electronic data concept and classification statement. The second part discusses the collection model of electronic data. By analyzing the discussion of the forensic model in academic circles and combining the judicial practice of our country, the author discusses the more reasonable model of forensics. The third part mainly discusses the electronic data collection and extraction method, which is the focus of this paper. In the investigation of criminal cases, the collection of electronic data should not only make full use of the traditional investigative techniques, but also use the new methods of forensic investigation, which are different from the traditional evidence. In order to collect electronic data directly, the new collection methods are discussed, such as electronic data checking, online network extraction and network monitoring and monitoring. The fourth part is the analysis of the fixed means of storage after electronic data collection. General evidence, its custody process is relatively simple, through sealing, seal guarantee no physical changes can be. However, electronic data has the characteristics of fictitious, invisible and changeable, which makes it very important to keep electronic data fixed. Therefore, electronic data fixation in addition to the general evidence of the custody of the method has its own unique fixed method. This paper mainly discusses several main methods of electronic data fixation, such as seizure, storage, backup, freezing, computing integrity check, photography, printing, video recording and so on. For the above several fixed methods, freezing electronic data and calculating the integrity check value are relatively novel methods of fixing evidence in criminal investigation. Therefore, this paper will focus on the application of these two fixed methods and the applicable methods. And the problems encountered in practice.
