环保组织参与环境民事公益诉讼问题研究

【摘要】：本文结合国内外社会团体参与民事公益诉讼的理论和实践,对我国环保组织参与环境民事公益诉讼的若干问题进行了分析研究。除引言和结语部分外,本文共分四章：第一章是环保组织参与环境民事公益诉讼的概述。本章简要分析了环境民事公益诉讼的概念并理清了其与相关诉讼的区别,同时对环保组织参与环境民事公益诉讼的必要性进行了分析。第二章阐述了环保组织参与环境民事公益诉讼的原告资格问题。本章在分析民事公益诉讼原告资格多元化的基础上,指出多元化的适格原告中,环保组织比检察机关、环保职能部门和公民个人更应当发挥提起环境民事公益诉讼的重要作用。第三章总结了环保组织参与我国环境民事公益诉讼的现状。本章通过分析环保组织的现状、环保组织参与环境民事公益诉讼的立法现状及司法实践,总结环保组织参与环境民事公益诉讼的障碍,指出环保组织在通过环境民事公益诉讼发挥保护环境的重要作用方面仍任重道远。第四章论述环保组织参与我国环境民事公益诉讼的制度构建。本章结合环保组织参与环境民事公益诉讼存在的问题,从明确具体诉讼规则、完善配套制度、强化自身建设等角度,为环保组织充分参与环境民事公益诉讼进行了制度构建。
[Abstract]:Based on the theory and practice of the participation of social organizations in civil public interest litigation at home and abroad, this paper makes an analysis and study on some problems of environmental protection organizations' participation in environmental civil public interest litigation in China. In addition to the introduction and conclusion, this paper is divided into four chapters: the first chapter is an overview of environmental organizations involved in environmental civil public interest litigation. This chapter briefly analyzes the concept of environmental civil public interest litigation and clarifies the difference between it and related litigation. At the same time, it analyzes the necessity of environmental protection organizations participating in environmental civil public interest litigation. The second chapter expounds the plaintiff qualification of environmental protection organizations participating in environmental civil public interest litigation. Based on the analysis of the diversity of plaintiff qualifications in civil public interest litigation, this chapter points out that environmental protection organizations should play an important role in bringing environmental civil public interest litigation, which is more important than that of procuratorial organs, environmental protection functional departments and individual citizens. The third chapter summarizes the current situation of environmental organizations participating in environmental civil public interest litigation in China. By analyzing the current situation of environmental protection organizations, the legislative status and judicial practice of environmental protection organizations participating in environmental civil public interest litigation, this chapter summarizes the obstacles for environmental organizations to participate in environmental civil public interest litigation. It is pointed out that environmental protection organizations still have a long way to go in playing an important role in protecting the environment through environmental civil public interest litigation. Chapter four discusses the system construction of environmental protection organizations participating in environmental civil public interest litigation in China. This chapter combines the existing problems of environmental protection organizations in environmental civil public interest litigation, from the specific litigation rules, improve the supporting system, strengthen their own construction, environmental protection organizations to fully participate in environmental civil public interest litigation system construction.
