人民法院职权调查取证制度研究

【摘要】：作为调查收集证据的主体之一的法院,职权调查取证是其行使审判职权应有的内容,也是民事诉讼当中证据调查收集制度的重要组成部分。对此,民事相关法律也作出了明确规定。伴随着司法改革新举措的不断向前推进以及诉讼理念向当事人主义的逐渐靠近与转变,人民法院调查取证的职权不断被弱化,职权调查取证的范围也不断被限缩,显然这是符合辩论主义原则要求的。但是,过分地对人民法院职权调查取证的权力予以限制也背离了人民法院作为发现真实的主体之一运用相关民事法律在遵循程序的基础之上作出正确裁判的目标和要求,产生了不少的负面影响,在理论界、实务界都激起了不少的争论。因此,在司法改革的这一时代背景下对于民事诉讼中人民法院职权调查取证制度的进一步深入研究是十分必要的。论文的引言部分对法院职权调查取证这一制度的国内外研究现状以及发展的趋势进行介绍,从而引出对法院职权调查取证制度研究的重要性。第一章通过对研究对象概念的界定以及对这一制度存在的价值进行阐述,从而有利于对研究对象有一个更深入的认识。第二章主要介绍人民法院职权调查取证制度的历史发展、存在的主要问题以及对现状成因的分析,有益于进一步完善该制度。第三章通过对两大法系的代表国家在这一制度上的考察,为人民法院职权调查取证制度的完善提供借鉴。第四章从制度层面以及思想层面提出了完善人民法院职权调查取证制度的几点建议,本文通过对民事诉讼中人民法院职权调查取证范围的进一步界定并细致的分析,进而对该制度的完善建议进行了阐述。
[Abstract]:As one of the main body of investigation and collection of evidence, the court of power of investigation and collection of evidence is not only the content of its judicial authority, but also an important part of the system of collecting evidence in civil proceedings. To this, civil relevant law also made clear stipulation. With the development of new measures of judicial reform and the approaching and transformation of litigation idea to litigant doctrine, the power of the people's court to investigate and collect evidence has been continuously weakened, and the scope of the power of investigation and collection of evidence has been continuously restricted. Obviously this is in line with the principle of argumentalism. However, the excessive restriction on the power of the people's court to investigate and collect evidence deviates from the objective and requirement of the people's court as one of the subjects to discover the truth and to make the correct judgment on the basis of following the procedure by using the relevant civil law. Has produced a lot of negative influence, in the theory circle, the practice domain has aroused a lot of debate. Therefore, under the background of judicial reform, it is necessary to further study the system of investigation and collection of evidence in civil litigation. The introduction of this paper introduces the current research situation and the development trend of the system of court power investigation and evidence collection at home and abroad, which leads to the importance of the research on the system of court power investigation and evidence collection. The first chapter defines the concept of the object of study and expounds the value of the system, which is conducive to a deeper understanding of the object of study. The second chapter mainly introduces the historical development of the system of investigation and collection of evidence in the power of the people's court, the main problems existing and the analysis of the causes of the present situation, which is beneficial to the further improvement of the system. The third chapter through the two legal system on behalf of the country in this system to provide a reference for the people's court authority investigation and collection of evidence system. The fourth chapter puts forward some suggestions on how to perfect the system of investigation and collection of evidence in the people's court from the system level and the ideological level. This paper defines the scope of the investigation and collection of evidence of the people's court in the civil litigation and makes a detailed analysis of the scope of the investigation and collection of evidence by the people's court. Furthermore, the suggestion of perfecting the system is expounded.
