司法责任制背景下案件指导机制的构建

【摘要】：司法责任制改革突出检察官的办案主体地位,对司法亲历性提出更高要求。案件指导机制作为检察系统内部的工作惯例,是检察一体的应然体现,在制度的形式层面具有行政性。检察一体化与司法亲历性并不矛盾,司法责任制背景下的案件指导机制须在检察权的司法属性与行政属性之间衡平博弈,并进行法治化重构,应强化指令权的柔性以弱化行政干预的可能,强化指导内容的司法属性、让责任落地以增强指导结果的刚性,从而真正达到提升司法公信力之目的。
[Abstract]:The reform of judicial responsibility system highlights the principal position of procurators in handling cases and puts forward higher requirements for judicial experience. As the internal working practice of the procuratorial system, the case guidance mechanism is the embodiment of the procuratorial system, and has the administrative character in the formal level of the system. There is no contradiction between procuratorial integration and judicial experience. Under the background of judicial responsibility system, the case guidance mechanism should balance the game between the judicial and administrative attributes of procuratorial power and reconstruct the rule of law. We should strengthen the flexibility of command right to weaken the possibility of administrative intervention, strengthen the judicial attribute of the guiding content, and let the responsibility fall to strengthen the rigidity of the guiding result, so as to achieve the purpose of enhancing the judicial credibility.
