职务犯罪信息情报导侦机制研究

【摘要】：信息情报在侦查活动中占据不可忽视的地位和作用,准确、及时的信息情报将会准确无误地把握侦查方向、缩短案件侦破的侦查周期,使侦查人员能够在较短的时间内高效地完成案件侦破。在职务犯罪案件的侦查活动中,信息情报发挥着至关重要的作用。而目前检察机关在职务犯罪案件的侦查活动中大部分还处于运用过去侦查的手段,还没有实现利用现有的较为科学的手段侦破职务犯罪案件。具体表现为检察机关在行使职务犯罪侦查权时对相应信息情报的管理、对职务犯罪信息情报的分析、研判等环节仍处于松散、无序、混乱的状态。突出表现在职务犯罪侦查人员大部分自身没有系统的信息情报方面的知识,导致职务犯罪侦查人员对于信息情报的概念认识与情报、线索概念相混淆;检察机关内部没有相应的规程来对信息情报的获取、收集、分析、研判、利用、存储、交流等方面加以规范,对信息情报的管理没有专门的部门机构及人员专职负责,导致职务犯罪侦查信息情报目前大多是处于零散的、封闭的、缺乏实效、不具有直接利用价值的状态。本文通过以云南省某基层检察院在办理职务犯罪案件的作为示例,探讨我国职务犯罪侦查信息情报管理机制在检察机关实际侦办职务犯罪案件活动中所起到的作用以及所产生的影响。本文分为四个部分,一是概念分析,正确定义职务犯罪信息情报导侦机制的概念是整个文章的基础,本文在归纳出了职务犯罪信息情报的概念的基础上对职务犯罪信息情报的来源途径作了陈述,对职务犯罪信息情报导侦机制的概念及特点作了阐述,详细论述了职务犯罪信息情报导侦机制促进正确、高效行使职务犯罪侦查权的优势;二是对目前我国云南某地区职务犯罪信息情报导侦的优势和不足进行了分析;三是对中外地区信息情报引导职务犯罪侦查进行了比较分析,试着探讨我国职务犯罪信息情报导侦机制的欠缺和不足等问题;四是尝试对我国职务犯罪信息情报导侦机制的完善提出了个人的看法。
[Abstract]:Information plays an important role in investigation activities. Accurate and timely information will accurately grasp the direction of investigation and shorten the investigation cycle of case detection. So that investigators can efficiently complete the investigation in a relatively short period of time. Information and intelligence play an important role in the investigation of duty crimes. At present, most of the activities of procuratorial organs in the investigation of duty crimes are still using the means of investigation in the past, and have not realized the use of the existing more scientific means to detect cases of duty crimes. The concrete performance is that the procuratorial organ is still in a loose, disordered and confused state in the management of the corresponding information, the analysis of the duty crime information, the research and judgment of the duty crime information when exercising the duty crime investigation power. Most of the duty criminal investigators have no systematic knowledge of information intelligence, which leads to confusion between the concept of information and clues. There are no corresponding procedures within the procuratorial organs to regulate the acquisition, collection, analysis, research and adjudication, utilization, storage and exchange of information and intelligence, and there are no specialized departments and personnel responsible for the management of information and intelligence. As a result, most of the information and information of duty crime investigation is scattered, closed, lack of practical effect, and has no direct value of utilization. This article takes a grass-roots procuratorate in Yunnan Province as an example to deal with the cases of duty crimes. This paper probes into the role and influence of the information and information management mechanism of duty crime investigation in the actual investigation and handling of duty crime cases by procuratorial organs. This paper is divided into four parts: one is the concept analysis, the correct definition of the concept of duty crime information investigation mechanism is the basis of the whole article. On the basis of summarizing the concept of duty crime information, this paper states the sources of duty crime information, and expounds the concept and characteristics of the guiding investigation mechanism of duty crime information. This paper discusses in detail the advantages of the information and intelligence guiding mechanism of duty crime in promoting the correct and efficient exercise of the power of investigation of duty crimes. The second is to analyze the advantages and disadvantages of the information guide investigation of duty crimes in a certain area of Yunnan Province. Thirdly, this paper makes a comparative analysis on the investigation of duty crime guided by information in China and foreign countries, and tries to discuss the deficiency and deficiency of the mechanism of guiding investigation of information on duty crime in China. The fourth is to try to improve the investigation mechanism of duty crime information and information.
