不予再审“管辖错误”后遗留问题研究

【摘要】：依现行法规定,当事人以"管辖错误"为由对管辖权异议裁定提出的再审申请,最高人民法院已不再审查。将"管辖错误"排除出裁定的再审范围后,作为例外,仍有必要对关涉仲裁协议和外国法院管辖这两类管辖权异议裁定进行再审。当事人以包括"管辖错误"在内的多项事由对生效判决申请再审时,如判决本身不存在错误,无需再对管辖问题进行审查,但判决本身存在错误时,仍有必要对管辖是否错误进行审查。
[Abstract]:In accordance with the current law, the Supreme people's Court has no longer examined the retrial applications made by the parties on the grounds of "jurisdictional errors" for adjudication of objections to jurisdiction. After the "jurisdictional error" is excluded from the retrial scope of the ruling, it is still necessary to retry the two categories of jurisdictional objection decisions concerning the arbitration agreement and the jurisdiction of the foreign court as an exception. When the parties apply for a retrial of the effective judgment on a number of grounds, including "jurisdictional errors", if the judgment itself is free of error and no further review of the jurisdictional issue is required, but when the judgment itself is erroneous, There is still a need to review the error of jurisdiction.
