【摘要】：我国的土地征收是国家对集体土地所有权的征收。我国土地征收补偿问题表现为：集体土地征收拆迁泛化；征收及实施征收土地的主体多元化,导致权责不明；土地征收中,被征收人仅享有不完整的知情权、参与权和申诉权；征收补偿行政及司法救济途径不健全。原因在于现行法律对“公共利益”的规定过于原则,相关条款与征收土地必须具有“公共利益”的目的存在矛盾；法律规定的土地征收补偿程序不合理不完备；集体土地征收与补偿法律规定的补偿标准低,补偿范围窄,地方政府通过征收土地的方式与民争利；政府主导土地征收,缺乏相应的制约机制。集体土地征收与补偿兼具民事行为与行政行为的双重性质。对被征收人的补偿应从适当补偿原则逐步过渡到完全补偿原则。我国土地征收补偿以金钱补偿为主,应建立我国失地农民的社会保障体系。对征收房屋的补偿方式可以考虑货币安置、产权调换安置、土地安置加货币补偿、重建等方式。通过立法明确界定公共利益的范围,同时就立法中没有规定的或者规定得有争议的交由人大或者常委会决定。为保证征收具有合法性,应建立公共利益审查机制,包括建立征收公告制度、征收听证制度和征收司法审查制度。完善征收补偿安置的听证程序和司法救济程序。借鉴“抑公扬私”的立法经验,制定独立的集体土地征收与补偿法。
[Abstract]:The land expropriation in our country is the state's collection of collective land ownership. As for the problems of the land expropriation in China: the generalization of collective land expropriation; expropriation of land expropriation and the implementation of diversification, lead to unclear responsibilities; land expropriation, expropriation has incomplete right, participation right and the right of petition; expropriation compensation administrative and judicial relief is not perfect. The reason is that the current legal provisions of the "public interest" is too principle, the relevant provisions and land expropriation must be "public interest" to the existence of conflicts; the procedure of land expropriation law imperfection; collective land expropriation and compensation law of the compensation standard is low, narrow the scope of compensation, the local government through land expropriation the way to compete with the people; the government led land expropriation, lack of appropriate control mechanism.
