我国土地发展权法律问题研究

【摘要】:土地发展权是变更土地用途之权,乃事关土地资源优化合理配置的一种新的权利形态。目前,我国关于土地利用的法律制度主要为土地使用权制度和土地用途管制制度。土地使用权对土地的使用仅在土地用途形态确定后对土地的利用,不涉及土地用途的变更,对优化配置土地资源存在一种先天不足。土地用途管制制度确立的是国家的行政审批权。行政审批权立足国家本位,追求国家利益,片面强调国家干预机制调节土地用途变更关系,忽视市场机制对土地用途变更关系的作用,亦忽视市场和政府对土地用途变更关系的综合调节。从这个意义而言,行政审批权是对变更土地用途、优化土地资源配置的一种悖离。 土地发展权法律制度可弥补上述两种制度优化配置土地资源之不足,为缓解人地关系中的根本矛盾人对土地的无限需求性和土地的极大稀缺性之间的矛盾提供了一种新的制度选择。 本文从以下四个部分来描述土地发展权这种新颖而重要的权利形态。 第一部分,土地与土地用途。本部分界定法学视野中的土地的质的规定性和外延,为科学设计土地发展权法律制度奠定前提和基础。土地发展权乃变更土地用途之权,这里的土地用途乃是立法上的土地用途,故土地发展权应是变更土地用途法定形态之权。探讨土地用途的法定形态之法理,为揭示土地发展权的具体内容的前提条件。 第二部分,土地发展权概述。这里阐述土地发展权的内涵与外延、具体内容、基本原则,从总的方面揭示土地发展权法律制度之特征。土地发展权内含可持续发展之理念,关注土地的社会整体经济效益与生态效益,追求代内人和代际人的土地安全与生态安全之目标。 第三部分,土地发展权的正当性研究。研究土地发展权的正当性,旨在昭示土地发展权之重要意义。目前,我国关于土地利用的法律制度主要为土地使用权制度和土地用途管制制度。上述两种制度均不能充分满足人们对土地的极大需求,对优化土地资源配置存在某种不足。土地发展权法律制度可弥补上述两种制度优化配置土地资源之不足,为缓解人地关系中的根本矛盾即人对土地的无限需求性和土地的极大稀缺性之间的矛盾提供了一种新的制度选择。笔者从理论和实践两个角度探究土地发展权的正当性的命题。
[Abstract]:The right to land development is the right to change land use and is a new form of rights related to the optimal and rational allocation of land resources. At present, the legal system of land use in our country is mainly land use right system and land use control system. Land use right to land use only after the determination of land use form, land use does not involve land use changes, there is a natural deficiency to the optimal allocation of land resources. The land use control system establishes the state's power of administrative examination and approval. The power of administrative examination and approval is based on the state standard, pursues the interests of the state, and unilaterally emphasizes that the mechanism of state intervention regulates the relationship between land use change and neglects the role of the market mechanism in the relation of land use change. It also ignores the market and the government's comprehensive regulation of the land use change relationship. In this sense, the power of administrative examination and approval is a contradiction to the change of land use and the optimization of land resource allocation. The legal system of land development right can make up for the deficiency of the above two systems in optimizing the allocation of land resources. It provides a new institutional choice for alleviating the contradiction between the unlimited demand for land and the great scarcity of land. This paper describes the new and important form of land development right from the following four parts. The first part, land and land use. This part defines the definition and extension of the land quality in the legal field of view, and lays a foundation for the scientific design of the legal system of the land development right. The land development right is the right to change the land use, and the land use here is the legislative land use, so the land development right should be the right to change the legal form of the land use. To explore the legal principle of the legal form of land use is a prerequisite for revealing the specific content of land development right. The second part is an overview of land development right. This paper expounds the connotation and extension of the land development right, its concrete content and basic principles, and reveals the characteristics of the legal system of the land development right from the general aspect. The land development right contains the concept of sustainable development, pays close attention to the overall economic and ecological benefits of land, and pursues the goals of land security and ecological security of intergenerational and intergenerational people. The third part is the research on the legitimacy of land development right. The purpose of studying the legitimacy of land development right is to show the importance of land development right. At present, the legal system of land use in our country is mainly land use right system and land use control system. These two systems can not fully meet the great demand for land, and there are some deficiencies in optimizing the allocation of land resources. The legal system of land development right can make up for the deficiency of the above two systems in optimizing the allocation of land resources. It provides a new institutional choice for alleviating the contradiction between the unlimited demand for land and the great scarcity of land in the relationship between man and land. The author explores the proposition of the legitimacy of land development right from the angle of theory and practice.
