论当代中国宪政文化的建设

【摘要】：宪政是一种生活秩序,是迄今以来保障人权最不坏的方式,它与每个人都息息相关。实行宪政是不可阻挡的历史潮流,是当今世界各国的普遍做法,更是解决当前中国发展过程中各种复杂问题的唯一出路。宪政文化是宪政有效运行的灵魂和基础,中国传统文化与西方宪政文化具有相契合的因素,并且具有与时俱进兼容并蓄的特点。我国近现代宪政文化建设失败是由于当时在内忧外患的背景下,被动地将宪政作为富国强兵、争权夺利的工具。当前我国宪政文化理论研究不够深入、宪法法律中宪政核心理念缺失、公民尚未树立宪政的信仰。域外尤其是儒家文化圈国家宪政文化建设的成功经验表明,宪政文化依赖于一定的经济、政治、社会和文化基础。当代中国宪政文化建设必须以人的幸福尊严为逻辑起点,树立历史和全球的意识,运用“拿来主义”的辩证方法,同时继承中国传统文化的宪政资源和借鉴人类文明有益的成果,协调推进宪政文化和宪政制度的建设,循序渐进地通过市场经济、公民社会、教育宣传和宪政实践等各个途径建设符合中国实际的宪政文化。
[Abstract]:Constitutionalism is an order of life, is by far the worst way to protect human rights, it is closely related with each person. Constitutionalism is an irresistible trend of history, is a common practice in the world today, it is the only way to solve the complicated problems in development process China. Constitutional culture is the soul and foundation the effective operation of the constitutional government, Chinese traditional culture and Western constitutional culture with combination of factors, and has characteristics of the times. The failure of fully inclusive and equitable modern constitutionalism culture construction in China is because of the background of the domestic trouble and foreign invasion, passive constitutionalism as powerful, power tool. The current study of China's constitutional culture theory is not deep enough, the core idea of lack of constitutional law, citizens have not yet set up the constitutional faith. Especially the Confucian cultural circle extraterritorial national constitutionalism culture construction success Experience shows that the constitutional culture relies on certain economic, political, social and cultural foundation. Chinese contemporary constitutionalism culture construction must take the happiness of human dignity as the logical starting point, establish the historical and global consciousness, the use of "dialectic ism", while inheriting traditional culture Chinese constitutional resources and learn from the useful achievements of human civilization to promote the construction of coordination, constitutional culture and constitutional system, step by step through the market economy, civil society, education and practice of constitutionalism constitutional culture in various ways to meet the actual construction of Chinese.
