【摘要】：宪政文化是根植于西方独特土壤中的一种文化,西方宪政精神的形成有其深刻而独特的文化背景,而作为西方传统文化中至关重要的基督教文化无疑对宪政精神的传承和发展起着不可忽视的作用。从基督教文化的角度对西方宪政精神的发展脉络进行一定的梳理,有利于更全面深刻地剖析西方宪政的生长机理及其实质内涵。目前国内对于基督教文化对西方宪政形成的影响的研究较少,理论界对基督教文化与西方宪政精神的关联性也没有足够的重视。本文将从基督教文化的视角对西方宪政进行审视,主要论述基督教文化对西方近现代宪政精神形成和发展的重要影响,以求对中国宪政的建设探索提供一定的思考。第一部分,主要论述基督教文化对古代宪政精神的传承。创立于古希腊而在罗马共和国时期成为国教的基督教以其独特的影响力在宣传基督教教义的同时充当了古代宪政精神的传承者,正是由于基督教的这种特征,使得欧洲古代的宪政精神得以较为完整的传承。第二部分,论述了中世纪时期教俗斗争、宗教改革运动以及古典自然法学派学说对于宪政精神发展的重要影响。中世纪时期的基督教不甘于仅在精神世界处于统治地位,从而对世俗权威发起了挑战,教俗之间的博弈使得分权思想得以孕育,为近现代宪政的发展奠定了坚实的思想基础。同时,以新教为旗帜的近代资产阶级革命以及古典自然法学家对基督教文化的批判为近现代宪政精神的发展注入了新的活力,也使保障人权及限制政府权力思想逐渐渗透到现代宪政精神之中。第三部分,着重阐述了基督教文化中对宪政精神起重要作用的内容,包括基督教的“约”的观念对于宪政人民主权思想形成的影响,教俗斗争对三权分立学说的推动作用以及基督教对上帝的信仰与宪法的至上性之间的关联。
[Abstract]:The constitutional culture is a kind of culture which is rooted in the unique soil of the West . The formation of the western constitutional spirit has its profound and unique cultural background , and the important Christian culture in the western traditional culture undoubtedly plays an important role in the inheritance and development of the spirit of the constitutional government . At present , there is little study on the influence of Christianity culture on the formation of western constitutional government , and there is not enough attention to the relationship between Christian culture and western constitutional spirit . This paper will examine the western constitutional government from the perspective of Christian culture , and mainly discuss the important influence of Christianity culture on the formation and development of modern constitutional government in the West . The first part mainly discusses the inheritance of the Christian culture to the spirit of the ancient constitutional government . In the second part , the author discusses the important influence of secular struggle , religious reform movement and classical natural law school doctrine on the development of constitutional spirit in the Middle Ages . In the Middle Ages , Christianity was not only in the dominant position in the spiritual world , thus laying a solid ideological foundation for the development of modern constitutional government . At the same time , the modern bourgeois revolution with the banner of Protestantism and the criticism of classical naturalist in Christian culture have injected new vitality into the development of modern constitutional government . The third part focuses on the content of the important role of the Christian culture in the spirit of the constitutional government , including the influence of the concept of " about " of Christianity on the formation of the sovereignty thought of the constitutional government , the promotion of the secular struggle against the three powers and the supremacy of Christianity on God ' s belief and constitution .
