【摘要】："法统"一词是民国初期流行的政治术语,其义是指权力的法律来源或权力的法律依据,用以判别政权的合法性与正当性。辛亥革命后制定的《中华民国临时约法》,使中华民国的权力获得了法律的依据。由此而确立了中华民国的"法统",维护法统的意识也在随即展开的法统斗争中而不断加强。民初发生的法统之争,其实质就在于争夺统治权的合法地位。但国民党南京政府颁布的《训政时期约法》却改变了《临时约法》确立的民国法统,成为国民党一党专政的法统,最终被新民主主义革命后确立的人民民主专政的法统所取代。
[Abstract]:The term "legal unification" is a popular political term in the early period of the Republic of China, which means the legal source of power or the legal basis of power. In order to judge the legitimacy and legitimacy of political power, the Provisional Treaty Law of the Republic of China, enacted after the Revolution of 1911, gave the power of the Republic of China a legal basis and thus established the "legal unity" of the Republic of China. The consciousness of maintaining legal unification was also strengthened in the ensuing struggle of legal unification. The dispute of legal unification occurred in the early Republic of China. The essence of it lies in the struggle for the legal status of the ruling power. However, the KMT Nanjing government promulgated the Treaty Law during the period of political discipline, which changed the Republic of China legal unification established by the Provisional Treaty Law, and became the legal unification of the Kuomintang one-party dictatorship. It was eventually replaced by the legal system of the people's democratic dictatorship established after the New Democratic Revolution.
