【摘要】：本文以共和国65年对迁徒自由有着绝对影响的户籍制度的建立和演变为时间线索,梳理中国公民迁徙自由的曲折成长历程,分析迁徙自由在新中国各个阶段的基本情况以及造成该情况的各种原因,主要分析迁徙自由与行政权力、土地制度、社会保障、经济成本和利益冲突的关系,并发现其中的问题所在,最后提出实现迁徙自由权的对策和方案。本文的主题思想是迁徙自由是公民的一项基本人权,是宪法确认和保障的权利,而非政府干预限制公民权利的权力,政府应当充分运用法律赋予的权力保障公民的迁徙自由权,切实做到权为民所用,情为民所系,利为民所谋,在营造起点公平和规则公正、实现均富目标的社会秩序下促进公民个人的更好地发展,共同实现伟大的中国梦。
[Abstract]:This paper takes the establishment and evolution of the household registration system, which has an absolute influence on the freedom of movement in 65 years of the Republic, as a time clue, and combs the tortuous growth course of the freedom of migration of Chinese citizens. This paper analyzes the basic situation of freedom of movement in each stage of the new China and the causes of the situation, mainly analyzes the relationship between freedom of migration and administrative power, land system, social security, economic cost and conflict of interests. And find out where the problems, and finally put forward the realization of the right to freedom of movement countermeasures and programs. The main theme of this paper is that freedom of movement is a basic human right of citizens, is the right recognized and guaranteed by the Constitution. The government should make full use of the power given by law to protect citizens' right to freedom of movement, and make sure that the right is used by the people, the feeling is for the people, and the interests are for the people. Under the social order of creating a fair starting point and fair rules and achieving the goal of equalizing wealth, we should promote the better development of individual citizens and jointly realize the great Chinese Dream.
