【摘要】：集会权利对我国宪法学学者来说并不陌生,但之于我国普通公民似乎并不熟悉。本文主要立足于各国集会权利的实践情况,致力于对我国宪法权利——集会权在其指导法律《集会游行示威法》的框架下的完善,以增强我国公民行使这一基本权利的可行性。文章从介绍集会权利概念和属性开始,再到探讨各国集会权利立法现状,最后回归到我国集会权利在立法和实践中的弊端及对应的解决途径,深入浅出地对我国《集会游行示威法》的可实践性作了完善性的分析和建议。文章主要分为四个部分：第一部分文章对集会以及集会权的起源、概念及内涵进行概括性的说明,主要讲解集会权的界定、属性和特点以及分类。并强调了集会权作为一项公民权利所带给公民个体的权利意义。第二部分主要介绍了公民集会权的域外法规制和国内法规制。其中,域外对公民集会权利的法律规定以普通法系和大陆法系为类别,分别以美、英、德、日四国为代表,分析了其公民集会权利法律保障的特点。最后介绍了我国宪法及其他法律法规对公民集会权利的保障情况。第三部分总结和分析我国立法对公民集会权保障的不足。从集会申请保障方面和实体实践保障方面入手,通过对我国集会权实践程序进行分析,指出我国集会申请程序中的缺陷,为增强我国公民集会权的启动性找准立足点。同时,还根据外国集会立法及集会权实践案例,对我国公民在集会权行使过程中需要面对的物质和安全保障挑战进行了对比分析,为提高我国公民集会权利的物质和安全保障提供解决思路。第四部分为本文最核心的章节,在该部分以文章第三部分分析指出的我国集会权利保障不足的具体问题为出发点,努力探索出一条适合我国国情的集会权利保障之路：从转变立法思想、变预防为保障、合理疏导非理性集会、简化报批程序,增强公民集会权的实践性、细化公民实施集会权过程中的保障措施、加大对公民集会权利的救济力度等。对我国现阶段公民集会权利行使中面临的问题进行理论和实践上的解答。
[Abstract]:The right of assembly is not strange for scholars of constitutional law in our country, but to the ordinary citizen of our country does not seem to be familiar with the practice. This paper is mainly based on the national right of assembly, is committed to our constitutional rights -- the right of assembly under the guidance of the legal framework to improve the demonstration method of < > the feasibility to enhance our in the citizens' basic rights. This article begins from the introduction of the concept and attribute of the right of assembly, then to discuss the legislative status of national assembly rights, and finally return to China's right of assembly and the corresponding defects in the legislation and practice of the solution, in to our country "demonstration law" can be practical for a complete analysis and suggestions. The article is divided into four parts:
The first part gives a general description of the origin, concept and connotation of the assembly and the right of assembly. It mainly explains the definition, attributes, characteristics and classification of the right of assembly, and emphasizes the significance of the right of assembly as a citizen's right to citizens.
The second part mainly introduces the civil rights of assembly and the extraterritorial regulation of domestic law. The legal provisions on civil rights to rally outside the common law and civil law into categories, respectively to the United States, Britain, Germany and Japan as the representative, analyze the characteristics of the civil law protection of right of assembly. Finally introduced security situation in our constitution and other laws and regulations on civil rights rallies.
The third part is the summary and analysis of deficiencies in China's legislation on the civil rights of assembly security. Starting from the aspects of entity and assembly applications security guarantee in practice, based on China's practice of the right of assembly process analysis, pointed out the defects of our assembly application, to start finding enhancing citizens' rights in China based on the rally point. At the same time also, according to the foreign legislation and the right of assembly assembly practice, the material and security challenges of our citizens will face in the process of the exercise of the right of assembly were analyzed, to provide solutions to improve the material and security of our citizens the right to assembly.
The fourth part is the core of this chapter, in our country the right of assembly part pointed out the analysis to the third part of the specific problems of insufficient security as the starting point, to explore a suitable for China's protection of the rights of assembly path: the transition from legislative thought, change prevention for security, ease of non rational and reasonable assembly, simplify the approval procedures, strengthening the practice of civil rights of assembly, the implementation of security measures in the process of refining the civil rights of assembly, to increase the citizens right of assembly's relief efforts. The theory and Practice on the answer to facing the present stage of our country citizen meeting right exercise in question.
