依宪治国背景下完善撤县设区的宪法学思考

【摘要】：中国城镇化率正快速提升,撤县设区成为适应这种变化的重要手段,地区经济发展使其具有必然性,但时至今日撤县设区还没有形成完善的变革模式,既缺乏明确的制度规范,又存在一定的盲目性和功利性,其法律依据、程序、标准均存在不足,难以满足地方制度改革的需要,面临合法性危机。撤县设区实质是地方权力的再次分配,应该由国家统一规划,遵循宪法对地方制度的原则性规定和其他法律对撤县设区的具体要求,健全撤县设区立法体系,明确县区权限的差别,并对撤县设区责任追究制度作精密设计和恰当安排。
[Abstract]:The rate of urbanization in China is increasing rapidly, the withdrawal of counties into districts has become an important means to adapt to this change, the regional economic development makes it inevitable, but up to now, it has not formed a perfect reform model. Lack of clear system norms, but also there is a certain degree of blindness and utilitarianism, its legal basis, procedures, standards are inadequate, difficult to meet the needs of local system reform. In the face of legitimacy crisis, the withdrawal of counties into districts is essentially the redistribution of local power, should be unified by the state planning, in accordance with the Constitution of the principles of the local system and other laws of the specific requirements for the withdrawal of counties and districts. It is necessary to perfect the legislative system of withdrawing county and district, to make clear the difference of county jurisdiction, and to make precise design and proper arrangement for the system of investigating the responsibility of withdrawing county and district.
