赦免制度的宪政分析

【摘要】：本文从赦免制度的历史渊源和概念出发,对赦免的主体、对象、内容、赦免权的权属及类型进行了厘定,综合考察了现代赦免制度的国内外现状,分析了我国赦免制度之不足,并以宪政制度为视角分析了我国赦免制度存在的依据及意义,对我国现代赦免制度的重构提出建议。文章除前言和结语外分为四个部分：第一部分为赦免制度概述,对中外赦免制度的历史沿革进行了梳理,综合评析了学界对于赦免主体、对象、内容、赦免权权属的不同观点,在此基础上对于赦免的概念提出了自己的观点——赦免的概念应表述为：国家元首或国家权力机关以国家名义宣告对犯罪人免除其罪,或者虽不能免除其罪,但免除或者减轻其刑,使刑事追诉权、刑罚裁量权或者刑罚执行权归于消灭的法律制度。第二部分为赦免制度的现状,分为国外现状与国内现状两部分。其中,国外现状按照英美法系和大陆法系,欧美和亚洲的不同特征分别选取了英、美、法、日四个国家为样本,对其赦免制度之现状进行叙述；国内现状则从立法和实践两个方面发掘我国赦免制度现状的特点及不足。第三部分为赦免制度存在的宪法价值及现实意义,分别以宪法理论和宪政实践为视角,从赦免与分权,法治,人权的关系以及现实意义着手,论证我国现代赦免制度存在的基础和依据,提出我国需要构建完善的赦免制度体系的观点。第四部分为我国赦免制度的重构,从赦免类型的重构、赦免程序的法典化、赦免制度的限制、完善相应的部门法四个方面展开,为我国重构现代赦免制度提出建议。
[Abstract]:Starting from the historical origin and concept of the amnesty system, this paper determines the subject, object, content, ownership and types of the amnesty power, and comprehensively investigates the present situation of the modern amnesty system at home and abroad, and analyzes the deficiency of the amnesty system in China.From the perspective of constitutional system, this paper analyzes the basis and significance of the existence of the amnesty system in China, and puts forward some suggestions for the reconstruction of the modern pardon system in China.In addition to the preface and conclusion, the article is divided into four parts:The first part is an overview of the amnesty system, combing the history of the amnesty system at home and abroad, and comprehensively evaluating the different viewpoints of the academic community on the subject, object, content, ownership of the right to pardon.On this basis, it puts forward its own view on the concept of pardon, which should be expressed as: the head of State or the organ of State authority, in the name of the State, declares that the offender is exempted from the crime, or that he cannot be exonerated from the crime.However, the legal system of exonerating or abating the penalty, making the right of criminal prosecution, the discretion of penalty or the power of execution of penalty to be exterminated.The second part is the current situation of amnesty system, which is divided into two parts: the present situation of foreign countries and the present situation of China.Among them, according to the Anglo-American law system and the continental law system, the different characteristics of Europe, America, France and Japan are selected as samples to describe the current situation of the amnesty system.The present situation of our country explores the characteristics and shortcomings of the current situation of the amnesty system from the aspects of legislation and practice.The third part is the constitutional value and practical significance of the amnesty system, respectively, from the perspective of constitutional theory and constitutional practice, from the perspective of pardon and separation of powers, rule of law, human rights and practical significance.This paper demonstrates the foundation and basis of the modern amnesty system in China, and puts forward the point of view that our country needs to construct a perfect pardon system.The fourth part is the reconstruction of the pardon system in our country, from the reconstruction of the type of pardon, the codification of the amnesty procedure, the restriction of the pardon system, and the perfection of the corresponding department law, the author puts forward some suggestions for the reconstruction of the modern amnesty system in China.
