和谐社会视野下的农民平等权研究

【摘要】：我国正经历由传统的农业社会向现代工业化国家转变，农民为国家的经济和工业发展作出了巨大的贡献和牺牲，但其平等权利却未能得到充分实现，农村居民与城市居民的权利差别逐渐影响到我国民主制度和法律制度的完善，损害了社会公平正义，制约了社会经济发展，甚至影响到社会的稳定和国家的长治久安。党中央提出构建社会主义和谐社会，民主法治、公平正义是题中之义，解决农民平等权问题不仅是妥善处理“三农”问题、促进新农村建设的需要，还是完善国家民主法治、弘扬社会公平正义的内在要求，更是贯彻“以人为本”、统筹城乡发展、落实科学发展观的客观要求。论文从平等权的理论入手，以中西方平等思想的发展轨迹为主线，探讨了平等权基本内涵，并对我国农民平等权的相关概念、特征和内容进行界定，指出农民平等权的实现对于社会主义和谐社会建设的重要意义，即有利于弘扬社会公平正义、完善社会民主法治、保障社会安定有序，推动社会和谐发展。虽然我国农民平等权在经济、政治、文化以及社会保障等方面取得了重大突破，但是中国传统思想中的特权等级思想依然存在，城乡二元经济结构限制了农民行使权利，法律制度落后于社会发展，农民权利救济不力，导致农民在经济上落后于城市，政治上话语权遭到削弱，，文化教育权利得不到充分保障，社会保障的全面覆盖还尚未完全实现。这些因素造成了我国城乡发展的不平衡，阻碍了农民平等权的充分实现，不利于社会经济持续健康发展。因此，我们要真正落实社会主义和谐社会“民主法治、公平正义、诚信友爱、充满活力、安定有序、人与自然和谐相处”的要求，必须贯彻“以人为本”、提升农民主体的平等意识和综合素质，促进农民全面发展，保障农民基本人权；执行“依法治国”的基本方略，健全社会民主制度和法律制度，确立有效的立法机制、监督机制和救济制度，保证农民平等权实现；深化户籍制度改革，增强社会活力，提高农民的经济地位、强化村民自治权利，保障农民话语权，从而维护社会安定有序，促进社会主义和谐社会建设。
[Abstract]:Our country is undergoing a transformation from a traditional agricultural society to a modern industrialized country. Farmers have made great contributions and sacrifices to the economic and industrial development of the country, but their equal rights have not been fully realized. The difference between the rights of rural residents and urban residents has gradually affected the perfection of democratic and legal systems in our country, damaged social equity and justice, restricted the development of social economy, and even affected the stability of society and the long-term stability of the country. The CPC Central Committee has proposed to construct a socialist harmonious society, democracy and the rule of law, fairness and justice is the meaning of the topic. To solve the problem of equal rights of peasants is not only the need to properly deal with the "three rural issues" and promote the construction of new rural areas, but also to perfect the democratic rule of law in the country. The inner requirement of carrying forward social fairness and justice is to carry out "people-oriented", to coordinate urban and rural development, and to implement the objective requirement of scientific development view. Starting from the theory of equality right, this paper discusses the basic connotation of equality right, and defines the relevant concepts, characteristics and contents of the equality right of farmers in China, taking the development track of equality thought in China and the west as the main line, and discusses the basic connotation of equality right. It is pointed out that the realization of peasants' equal rights is of great significance to the construction of a harmonious socialist society, that is, it is conducive to carrying forward social fairness and justice, perfecting social democracy and rule of law, ensuring social stability and order, and promoting the harmonious development of society. Although great breakthroughs have been made in the economic, political, cultural and social security aspects of the equal rights of peasants in China, the traditional Chinese ideology of privilege and hierarchy still exists, and the dual economic structure between urban and rural areas limits the exercise of farmers' rights. The legal system lags behind the social development and the peasants' right relief is weak, which leads to the peasants lagging behind the city economically, the political right of speaking being weakened, the right of culture and education not being fully guaranteed, and the comprehensive coverage of social security has not yet been fully realized. These factors lead to the imbalance of urban and rural development in China, hinder the full realization of farmers' equal rights, and are not conducive to the sustainable and healthy development of social economy. Therefore, in order to truly implement the requirements of a harmonious socialist society, such as democracy and the rule of law, fairness and justice, honesty and friendship, vitality, stability and order, harmony between man and nature, we must carry out the "people-oriented" principle. To promote the equal consciousness and comprehensive quality of the main body of farmers, to promote the all-round development of peasants, to guarantee the basic human rights of peasants, to carry out the basic strategy of "governing the country according to law", to perfect the social democratic system and the legal system, and to establish an effective legislative mechanism. To ensure the realization of equal rights for peasants, to deepen the reform of the household registration system, to enhance social vitality, to enhance the economic status of farmers, to strengthen villagers' autonomy rights, and to safeguard the right of peasants to speak, so as to maintain social stability and order, We will promote the building of a harmonious socialist society.
