我国刑事司法解释体制中存在的问题与对策

【摘要】：行为犯与结果犯是针对刑法分则基本犯的既遂形态而言的,只有采取修正的既遂标准说才能实现对行为犯概念的准确界定。行为犯是指在犯罪构成客观要件中仅包括行为要素,并以行为本身侵犯法益的危险性作为基本犯成立条件的犯罪,其处罚根据即抽象危险。行为犯与结果犯之间是一种非此即彼的择一关系或者对立关系,采用这一理论区分就可以涵盖基本犯的所有类型。刑事司法解释在实践运用中发挥了极其重要的作用,但其自身仍然不可避免地存在着一些问题,如:解释主体混乱,司法解释借"解释"之名、行"立法"之实,不同机关间的司法解释存在冲突和矛盾等等。因而刑事司法解释一直饱受诟病,究其原因,主要在于司法解释权无宪法依据、司法解释权缺乏有效的监督、功利主义和本位主义对司法解释权的影响。因此,我国应在宪法中明确司法解释权,严格规范司法解释的主体,完善司法解释制定程序,从而从根本上完善司法解释。本刊编辑部特邀相关专家对以上问题进行研究,得到了一些对此问题素有研究的学者的积极回应,供读者参考。
[Abstract]:As for the accomplished form of the basic crime in the special rule of criminal law, only by adopting the modified accomplished standard theory can the concept of the act crime be accurately defined. Crime of conduct refers to a crime that contains only the elements of conduct in the objective elements of the constitution of a crime and takes the danger of the act itself as the basic condition for the establishment of the crime. The penalty basis is abstract danger. It is a kind of opposites or opposites between the behavior crime and the resultant crime, and it can cover all types of basic crime by using this theoretical distinction. Criminal judicial interpretation plays an extremely important role in practice, but there are still some unavoidable problems, such as confusion of interpretation subject, practice of "legislation" by judicial interpretation in the name of "interpretation". There are conflicts and contradictions in judicial interpretation between different organs. As a result, criminal judicial interpretation has been criticized, the main reason is that the judicial interpretation power has no constitutional basis, judicial interpretation power lacks effective supervision, utilitarianism and localization of the influence of judicial interpretation power. Therefore, our country should make clear the power of judicial interpretation in the constitution, strictly standardize the subject of judicial interpretation, perfect the procedure of establishing judicial interpretation, so as to improve the judicial interpretation fundamentally. The editorial department of our journal specially invited relevant experts to study the above problem, and got some positive responses from scholars who have been studying this problem for readers' reference.
