征收安置房法律问题研究

【摘要】:自上个世纪九十年代末以来,城市化进程加快而发生了大规模的集体土地的征收和国有土地上的房屋征收(俗称拆迁)活动,导致了大量征收安置房的修建,亦产生了许多需要解决的法律问题。 征收安置房与一般安置房略有不同,它是基于征收行为而引发的,由政府出资或政府主导、社会出资建设的,用以保障失地农民和城镇居民的基本居住条件的社会保障房。并且,从性质上来看,征收安置房实质上是一种准公共产品,兼具了公共产品和私人产品的特征。征收安置房的类型繁多,最常见的分类是根据建设用地的性质的不同,分为集体土地上的征收安置房和国有土地上的征收安置房两类。其中,集体土地上的征收安置房是目前争议最大的一类安置房。 具体来说,由于房屋权属界定不清、土地权属差异和房屋本身的性质存在争议,实务操作中出现了许多有待解决的法律问题。具体包括:征收安置房的权属问题、征收安置房土地的权属问题和征收安置房的交易问题等。发现征收安置房的所有权并不完整,征收安置房的土地不能采用集体土地以及征收安置房的交易急需规引等。解决安置房权属问题的思路和解决安置房用地的思路是互相联系的,必须使用国有土地建设安置房并确保安置房产权完整。解决安置房权属问题和安置房用地问题为安置房交易问题提供了基础,在使用国有土地建房和保证房屋产权明晰的前提下,政府应当适当干预安置房交易市场,并制定科学的法律规则对交易进行规引,并且,交易双方必须理性对待此类房屋交易问题。
[Abstract]:Since the late 1990s, the acceleration of urbanization has led to the large-scale expropriation of collective land and the expropriation of houses on state-owned land (commonly referred to as demolition and relocation), which has led to the construction of a large number of expropriated and resettled houses. There are also many legal problems that need to be solved. The expropriation house is slightly different from the general house, which is caused by the expropriation behavior, financed by the government or led by the government, and constructed by the society, which is used to guarantee the basic living conditions of the landless peasants and the urban residents. Moreover, in nature, the rehousing is a kind of quasi-public goods, which has the characteristics of public goods and private goods. There are many types of rehousing, the most common classification is according to the nature of the construction land, divided into collective land on the expropriation of resettlement houses and state-owned land on the expropriation of two types of resettlement houses. Among them, collective land on the expropriation of housing is the most controversial type of housing. Specifically, due to the unclear definition of housing ownership, the difference of land ownership and the nature of the house itself, there are many legal problems to be solved in practical operation. It includes: the ownership of the house, the ownership of the land and the transaction of the house. It is found that the ownership of the rehousing is not complete, the land of the rehousing can not be taken collective land and the transaction of the expropriation of the resettlement house is in urgent need of regulation and so on. The idea of solving the problem of the property right of the resettlement house and the idea of solving the land for the resettlement house are interrelated, so we must use the state-owned land to build the resettlement house and ensure the integrity of the property right of the house. The settlement of the problem of the ownership of rehousing and the issue of land use for rehousing provide the basis for the transaction of rehousing. On the premise of using state-owned land to build houses and to ensure the clarity of property rights of housing, the government should intervene appropriately in the market for rehousing transactions. Moreover, both parties must deal with this kind of housing transaction rationally.
