人身自由的限制研究

【摘要】：人身自由,又称人身自由权或身体自由或人身自由不受侵犯权,就是指身体活动的自由,人的身体不受非法拘留、逮捕和其他拘束而不被强行拘禁于某个场所。保障人身自由具有重要的意义,因此,对其的限制应当遵循宪法和法律,对人身自由的限制应当受到严格的限制:必须遵守法律保留原则;遵循限制条件明确化原则;遵循比例原则,让限制的目的和手段得到均衡;遵循正当程序原则;遵循权利救济权利原则,实现公平正义等。我国目前人身自由限制出现的部门法不同进行分类,主要类型有:宪法上的限制、刑事法上的限制、民事法上的限制以及行政法上的限制等,但存在法律空白、漏洞、冲突,欠缺正当程序、缺乏救济途径等问题。因此,必须规范人身自由的限制,解决存在的问题。
[Abstract]:Freedom of person, also called the right to liberty of person or liberty of body or inviolability of liberty of person, refers to the freedom of physical activity, the freedom of human body from illegal detention, arrest and other restraints from being forcibly detained in a certain place. Therefore, the restriction of personal liberty should follow the constitution and law, and the restriction of personal freedom should be strictly restricted: the principle of legal reservation, the principle of clear restriction condition, the principle of restriction and the restriction of freedom of person should be strictly restricted. Follow the principle of proportionality and balance the ends and means of restriction; follow the principle of due process; follow the principle of right to remedy and realize fairness and justice. At present, the department law of personal freedom in our country is classified differently. The main types are: constitutional restriction, criminal law restriction, civil law restriction and administrative law restriction, but there are legal gaps, loopholes, conflicts, etc. Lack of due process, lack of remedies and so on. Therefore, we must regulate the restriction of personal freedom and solve the existing problems.
