【摘要】：宪政危机是国家宪政发展过程中客观存在的一种非常态化的动态现象。对其研究可以使我们更好地了解、把握一个国家的宪政制度、宪政价值以及宪政文化。众所周知,对宪政的研究以美国范式最为典型,因此对美国宪政危机问题的探讨也更具代表性。在过去的两个世纪里,美国宪政的运行由于受到经济、法治、政治等因素的影响而多次产生危机,其中以1861年美国南北战争、1973年水门事件、2000年美国总统大选最为典型。在这些危机中,冲突各方通常采取诉讼手段及政治手段使其得以解决。最后,笔者希望增强危机的预警意识、化解危机的手段选择和解决危机的文化作用等启示可以对成型的宪政国家尤其是对宪政建设国家起到良好的借鉴作用。
[Abstract]:Constitutional crisis is a non-normal dynamic phenomenon in the process of constitutional development. The research on it can make us understand and grasp a country's constitutional system, constitutional value and constitutionalism culture. As we all know, the research of constitutionalism is most typical in American paradigm, so it is more representative to discuss the crisis of American constitutionalism. In the past two centuries, the operation of American constitutionalism has been affected by economy, rule of law, politics and other factors. Among them, the American Civil War in 1861, Watergate in 1973, and the presidential election in 2000 were the most typical. In these crises, parties to a conflict usually resort to litigation and political means to resolve them. Finally, the author hopes to strengthen the crisis early warning consciousness, the choice of the means to resolve the crisis and the cultural role of resolving the crisis, and so on can play a good reference role to the shaping constitutional government country, especially to the constitutionalism construction country.
