强迫失踪与国家的人权保护责任

【摘要】：强迫失踪或非志愿失踪是一种严重的侵犯人权行为。国际社会高度关注强迫失踪问题,要求主权国家保护国内人民免遭强迫失踪的国际规范已经逐步得到确立和发展。"保护的责任"则是国际社会人权保护观念与原则的新发展,其所蕴含的总体性的原则观念和框架义务对各种人权保护构成了新的原则指导和依据,以及相关规范进一步变化发展的基础与动力。在"被强迫失踪或非志愿失踪问题"方面,需要依据"保护的责任"的国际新观念与原则不断地明确和强化"强迫失踪问题"的国内治理责任和实践,同时,反过来进一步丰富和推进"保护的责任"的内涵构成与具体实施。
