文化权利实现的国家保护义务

【摘要】：现今,越来越多的人开始关注文化权利的相关问题。本文将文化权利分为几大部分进行探讨,从概念、属性、内容、特点、实现以及保证等诸多方面进行分析,作为人权中的一项重要权利,文化权利意味着每个人都应该在相关领域获得保证和实现的机会。认清文化权利的意义对于我们来讲并不是一项困难的任务并且我们可以提出一系列可能问题来分析文化权利存在的问题。首先,随着我国改革开放政策的实施,以及经济的快速增长使得文化权利应该得到我们社会中每一个公民的重视。由于一些公民未能意识到文化权利对于自身发展的重要性所在,他们在日常社会生活中诸多错误的观念都体现在每个细节之中。现今的社会,无论你是在生活中还是在工作中,各种侵权事件经常发生。从某种意义上来说,侵权事件就像潘多拉的盒子,一旦打开势必会产生各种不可预期的不理后果。因此,基本权利的保护必须在国家的监督以及个人权利意识之下才能有利于国家以及个人发展与繁荣。再者,还有一些问题则归因于公民自身的文化权利意识的缺乏,这一问题在农村更加突出。虽然农村中的法制建设和生活水平已经逐步提高,但是自身的权利意识则又有退化。关注于个人的权利意识我们可以得知,公民的权利意识的缺乏在于自身的权利的认识以及在相互交往中对于权利的漠视的相互影响,这并不利于我们社会的健康的发展。为此我们必须提出一些新的建议来促使公民对于自身文化权利的重视,虽然这种挑战是不能低估的。总之,文化权利必须引起我们自身的重视。依我来看,我认为我们应该采取一些有效的措施来予以解决这种社会现象。一方面,一个广泛的权利意识的宣传应该被广泛的实施,从而使得公民意识到自身权利意识的重要性之所在。另外,政府应该制定有关配套的措施以及严格依照法律来处理相关的侵权行为等等,这又这样我们才能生活在一个和谐的社会之中。
[Abstract]:Nowadays, more and more people begin to pay attention to the related issues of cultural rights. In this paper, cultural rights are divided into several parts to discuss, from the concept, attributes, content, characteristics, realization and guarantee and other aspects of analysis, as an important human rights, Cultural rights mean that everyone should have access to guarantees and opportunities for realization in relevant fields. Recognizing the meaning of cultural rights is not a difficult task for us and we can ask a series of possible questions to analyze the problems of cultural rights. First of all, with the implementation of the policy of reform and opening up, and the rapid economic growth, cultural rights should be valued by every citizen in our society. Because some citizens fail to realize the importance of cultural rights to their own development, many misconceptions in their daily social life are embodied in every detail. In today's society, whether you are in your life or in your work, all kinds of infringing incidents often occur. In a sense, infringement is like Pandora's box, which, once opened, is bound to have unpredictable consequences. Therefore, the protection of fundamental rights must be under the supervision of the state and the consciousness of individual rights in order to benefit the development and prosperity of the country and individuals. Moreover, some problems are attributed to the lack of awareness of cultural rights of citizens themselves, which is more prominent in rural areas. Although the construction of legal system and living standard in rural areas have been gradually improved, but their own rights awareness has been degraded. We can know that the lack of citizen's awareness of rights lies in the awareness of their own rights and the mutual influence of disregard for rights in their mutual contacts, which is not conducive to the healthy development of our society. To that end, we must come up with some new proposals to encourage citizens to attach importance to their own cultural rights, although this challenge cannot be underestimated. In short, cultural rights must attract our own attention. In my opinion, we should take some effective measures to solve this social phenomenon. On the one hand, a wide awareness of rights should be widely implemented so that citizens realize the importance of their own awareness of rights. In addition, the government should formulate relevant measures and strictly follow the law to deal with related violations and so on, so that we can live in a harmonious society.
