宪法解释方法的运用——以德国艾尔弗斯案为例

【摘要】：中国现有的宪法解释学研究多注重宏观的理论研究和法哲学层面的思考,缺乏在个案中对宪法解释的理解和分析。艾尔弗斯案在德国基本权利教义学体系中具有极其重要的地位。通过此案来观察和说明德国宪法法院对诸种宪法解释方法的运用,以及在此基础上形成论证和判决的过程,可以为中国当前的宪法解释学研究提供有益的思路与借鉴。
[Abstract]:The existing studies of constitutional hermeneutic in China pay more attention to macro theoretical research and philosophical thinking of law, but lack of understanding and analysis of constitutional interpretation in individual cases. The Elves case plays an extremely important role in the German educational system of fundamental rights. Through this case, we can observe and explain the application of various constitutional interpretation methods by the German Constitutional Court, and the process of forming argumentation and judgment on this basis, which can provide useful ideas and references for the current study of constitutional hermeneutic in China.
