论虐待罪的发展与完善

【摘要】：近年来,“虐待”一词成为网络热词见诸各大网站,很多虐待事件受到了社会的高度关注。与以往不同的是,这些虐待事件都突破了家庭的界限,变得复杂多样,并暴露出了许多新的虐待问题,因此,我国虐待罪规定的合理性遭到了众多法学家的质疑。受多方面因素的影响,我国法律对此类事件的规制已显得力不从心,《刑法》第二百六十条关于虐待罪的规定一直受到社会的广泛关注,进而,虐待罪在法学界产生了很大反响,发展和完善虐待罪的呼声在法学界不断高涨。我国现行刑法修订于1997年,自1999年到2011年以来,先后经历了八次修正,但在这几次修正案中,均未涉及虐待罪的相关规定。笔者认为,新形势下,根据我国当前的社会状况,对虐待罪进行修正,时机已经成熟。本文从完善与发展虐待罪着手,通过对虐待罪立法之不足分析,结合我国国情及国外相关经验,提出立法建议,恳请大家指正。
[Abstract]:In recent years, the word "abuse" become a network of hot words in each big website, a lot of abuse by the attention of the society. It is different from the past, the abuse broke through the boundaries of family, has become complex and diverse, and exposed many new problems in China therefore, abuse, crime of abuse provisions the rationality has been questioned by many jurists. Influenced by many factors, China's legal regulation of the incidents has appeared to be inadequate, "the provisions of the criminal law on the crime of abuse of > 260th has been subject to widespread concern in society, and the crime of abuse, caused a great echo in the law field, the development and perfection of the crime of abuse the voice in the law field rising.
The current criminal law of China revised in 1997, since 1999 to 2011, has gone through eight revisions, but several times in this amendment, were not involved in the relevant provisions of the crime of abuse. The author believes that under the new situation, according to the current situation of the society of our country, the crime of abuse is modified, the time is ripe. This article from the development and perfection of the crime of abuse by hand, lack of legislation of the crime of abuse of the analysis, combined with China's national conditions and foreign experience, put forward the legislative suggestion, please correct me.
