建言增设新罪现象的反思

【摘要】：学界存在设立各种新罪的立法建言现象,有的建言入罪行为并不值得刑法规制,有的认为可以通过刑法解释方式合理解决,有的罪名增设没有合理协调好其与关联罪名之间的共存关系。建言设立新罪应该坚持刑法解释用尽原则、立法条款协调化原则和刑事立法迫不得已原则。对于新近通过的立法条款,学界更应该考虑如何强化司法适用,睿智的法学研究者不是着力批判法律,而是善于解释法律。
[Abstract]:There is a phenomenon of legislative advice on the establishment of various new crimes in academic circles. Some of them do not deserve to be regulated by criminal law, while others think that they can be reasonably solved by means of criminal law interpretation. Some of the additional charges do not reasonably coordinate the coexistence between them and the related charges. It is suggested that the establishment of new crimes should adhere to the principle of exhaustion of criminal interpretation. The principle of harmonization of legislative provisions and the compelling principle of criminal legislation. For the newly adopted legislative provisions, scholars should consider how to strengthen judicial application. Wise legal researchers do not focus on criticizing the law. They are good at explaining the law.
