网络犯罪的刑法空间效力研究

【摘要】：随着科技日新月异的发展，人类已经进入到网络时代。网络作为一种瞬间生成、实时互动、高度共享的传播媒介，将相隔万里的世界各地连为一体，真正实现了“天涯若比邻”。然而，网络如同“潘多拉宝盒”，带给人们无限惊喜的同时也释放出“灾难乌云”——网络犯罪。本文针对网络犯罪的空间效力问题，通过学理梳理和案例分析，结合相关网络技术原理，认为属地原则是解决网络犯罪空间效力的根本立足点，进而提出确定网络犯罪行为地和结果地的标准，最后总结了网络犯罪空间效力冲突的协调途径。全文共分四部分：第一部分是对网络犯罪概述。首先，通过对何谓网络、网络犯罪与计算机犯罪的关系、网络犯罪是刑法学意义上的概念还是犯罪学意义上的概念等三个问题的阐释以界定网络犯罪的定义；其次，概括了网络犯罪的发展趋势；最后归纳了网络犯罪的特征，整合了网络犯罪的类型，提出了不同于计算机犯罪的本质特征，并以网络犯罪所涉及的区域将其划分为跨境网络犯罪、跨国网络犯罪以及跨国和跨境相混合的网络犯罪。第二部分是网络犯罪空间效力的基础理论分析。首先，提出刑法空间效力不同于刑事管辖权；其次，阐述分析网络犯罪刑事管辖的相关学说；最后，，以属地原则作为网络犯罪刑事管辖的立足点并对其进行具体诠释。第三部分主要论述网络犯罪刑法空间效力机制的确立，从网络技术入手，并结合典型案例分析以论证对于网络犯罪应当以属地原则作为管辖原则的合理性，这其中，又以确定犯罪行为地和犯罪结果地作为解决问题的关键。第四部分提出网络犯罪刑法空间效力冲突的协调途径，主要是从国际和区际两方面探讨解决网络犯罪刑法空间效力冲突的原则和规则。
[Abstract]:With the rapid development of science and technology, human beings have entered the network age. As a medium of instant generation, real-time interaction and highly sharing, the network will be connected in a whole world thousands of miles apart. However, the Internet, like Pandora's Box, has given people endless surprises and released the "disaster cloud"-cybercrime. Aiming at the problem of spatial effectiveness of cybercrime, through theoretical analysis and case analysis, this paper holds that the territorial principle is the fundamental foothold for solving the spatial effectiveness of cybercrime. Then it puts forward the standard of determining the place and result of cybercrime, and finally summarizes the ways to coordinate the conflict of space effectiveness of cybercrime. This paper is divided into four parts: the first part is an overview of network crime. First, through the analysis of what is network, the relationship between network crime and computer crime, The definition of cybercrime is the concept of criminal law or the concept of criminology in order to define the definition of cybercrime; secondly, the development trend of cybercrime is summarized; finally, the characteristics of cybercrime are summarized. This paper integrates the types of cybercrime, puts forward the essential characteristics different from that of computer crime, and divides it into cross-border cybercrime, transnational cybercrime and transnational and cross-border cybercrime according to the region involved in cybercrime. The second part is the basic theoretical analysis of the spatial effectiveness of cybercrime. Firstly, it puts forward that the spatial effectiveness of criminal law is different from criminal jurisdiction; secondly, it expounds the relevant theories of analyzing the criminal jurisdiction of cybercrime; finally, Taking the principle of territoriality as the foothold of criminal jurisdiction of cyber crime and explaining it concretely. The third part mainly discusses the establishment of the spatial effectiveness mechanism of the criminal law of network crime, starting with the network technology, and combining with the analysis of typical cases to demonstrate the rationality of the principle of jurisdiction over the principle of territoriality. To determine the place of crime and the result of crime as the key to solve the problem. In the 4th part, the author puts forward the way to coordinate the conflict of the space effect of the criminal law of cybercrime, which mainly discusses the principles and rules of solving the conflict of the space effect of the criminal law of the network crime from the international and the interregional aspects.
